    Hi kima point 1 you'll already filled it in so should'nt have to fill it in again.

    point 2 i would send it to hsbc if it's wrong they'll tell you, i sent my complaints into hsbc not the underwriter

    point 3 i've now claimed on a LTSB loan from 1995, the statute of limitations doesn't really apply certainly not according to the fsa 10/12 assessment, hsbc are a good one for this 6 year business as thats what they tell everyone, if hsbc have no info on "back" years fos guidance says (quote) that premiums for the years they can't fill in can be estimated on past average premiums, i would certainly challenge this you could tell the bank you will contact the fsa for guidance that should make them change there tune a bit, good luck.:)

    OMG - you won't believe it !!!

    After the letter saying they weren't paying me because they claimed I was BR, I sent them a scan and a hard copy of the DN. I was expecting my whole claim to fall apart from this point onwards. This morning I had an email sent at 7.50am saying....

    "Good morning

    Jon Forey has asked me to contact you as we are trying to arrange to settle your complaint on the sale of your Business Loan Repayment Insurance policies. It has been agreed now that payment will be made to you, but your accounts were in the name of Ms M Crawley. I have checked with Wholesale Banking Recoveries but their records are also held in the name of M Crawley with no evidence of a change of name.

    We can issue payment in the name of M Crawley now but we were concerned that you might not be able to bank the cheque. Could you let me know if you are happy to receive payment this way or let me have sight of confirmation of your change of name, if you would prefer a cheque payable to M Williams

    I am sorry for the continued delay"

    WOW - I'm gobsmacked, progress at last. I'm scanning in my marraige certificate as we speak and am sending it straight off.

    Thanks guys for all your help - will let you know when I hear more.

    Mmmmm... got another email back ten minutes after sending marriage certificate, advising me that I'd have the cheque by the end of the week !!!

    Am really pleased but bit confused - not had any calculations or an offer. I just hope the cheque is in the region of what I was expecting.

    Hi is this the bank your dealing with or the fos, i'd say it's very unusual not to have calculations so you know at least ballpark what you'd get back, i'd contact them about this mich and get some figures. steve

    Got a reply back from her with some figures which total up to about £1k below what I was expecting.

    I want to ask about the interest to see if thats included but I can't remember what the two different types are called. I know the first is a refund of the interest paid on the original loan on the amount of the PPI but whats the other one called that around 8% ??

    So have heard back from Egg today (send original complaint May 2011) they are unable to uphold my complaint. Please see response received:

    We understand from your complaint that it concerns the sale of PPI (CRP) insurance; in particular you are of the opinion that you may have been mis-sold this product because:

    - The PPI was added without your knowledge
    - You were not asked whether you already had any existing insurance or employer benefits that would cover your repayments.
    - You believe the CRP was a pre-ticked box
    - You were part-time
    - You were very surprised CRP was on this card
    - You could never claim against CRP

    After carrying out a full review of yoru account, your purchased the insurance through the Egg website on 10 September 2001

    Our online sales process:

    - Does not require you to take repayment protection insurance as a condition of obtaining the credit card
    - Does not provide an advisory service
    - Required you to positively confirm that you wished to purchase this policy during the online application
    - Provided full terms and conditions of the policy and requested you read them before submitting

    In addition, we have donducted a review of the documentation you viewed during the sale. We are satisfied that the documentation presented accurately described the scope of the policy, and was sufficient to provide you will all of the information necessary to inform you of the terms and conditions of the policy. In light of the above we are unable to uphold your complaint.

    If you are unhappy, etc., etc., you may now ask the FOS to review your complaint and have six months......... You may consider this letter to be our final response, etc......

    I still feel I was mis-sold particularly because I was part-time, and I do believe it was a pre-ticked box.

    This was there final response. Do you 'experts' out there feel I should send a SAR so that I also have sight of what they are saying they are seeing, because as it was done online, I do not have a copy of this, but just have their word for it (and to be honest, do not trust them at all). They could have sent me copies of this with their final response letter to prove it, but have not.

    I am definately going to take further, but would like your ideas please. Thanks
