We are satisfied that the documentation presented accurately described the scope of the policy, and was sufficient to provide you will all of the information necessary to inform you of the terms and conditions of the policy. In light of the above we are unable to uphold your complaint.
If you are unhappy, etc., etc., you may now ask the FOS to review your complaint and have six months......... You may consider this letter to be our final response, etc......
I still feel I was mis-sold particularly because I was part-time, and I do believe it was a pre-ticked box.
This was there final response. Do you 'experts' out there feel I should send a SAR so that I also have sight of what they are saying they are seeing, because as it was done online, I do not have a copy of this, but just have their word for it (and to be honest, do not trust them at all). They could have sent me copies of this with their final response letter to prove it, but have not.
I am definately going to take further, but would like your ideas please. Thanks

Hi beverley it is harder to prove misold with an online application but not impossible, people do have online application upholds, if you don't trust the bank yes do a sar for piece of mind and yes the banks will lie to you, as you might remember by some of my earlier posts LTSB did it to me and have told me i had no ppi on my credit cards which is cobblers and yes i've sarred them, go for it and keep us informed.:) good luck0 -

First and foremost, have you looked online and is it the same web site you applied from. If not, they will need to prove to you what they state above. A SAR will get you this information but you must be specific in your request
Even though applied online, did you receive hard copy of everything including the policy.
Egg are one of those outfits who will try to wriggle out so get tough with them, they must prove to you what they are stating0 -
Got a reply back from her with some figures which total up to about £1k below what I was expecting.
I want to ask about the interest to see if thats included but I can't remember what the two different types are called. I know the first is a refund of the interest paid on the original loan on the amount of the PPI but whats the other one called that around 8% ??
Sorry mich missed your post, they should also pay you 8% from the time you took out your loan to the time they give you your calculations they should put you back in the same position you'd have been in without the ppi being applied0 -

I'd agree 100% with Cap on this one - SAR is definitely the way forward for this kind of response
Also I think the FSA regs may also be of use:
(PS10/12):
3.3.5 G The firm should not reject a complainant’s account of events solely on the basis that the complainant signed documentation relevant to the purchase of the policy.
(But obviously the above is more aimed at face to face rather than online)
The fact it was a non advised sale is no excuse, they should make sure that you are fully aware of the facts - how much it costs, the benefits, any likely exclusions, etc-

Also (just remembered this) there was some controversy that a lot of Egg online apps had the PPI box pre ticked and it relied on you unticking it

Thanks for all your comments - and also thank you tifosi for this link (which I had seen before and made copies of just in case). I am sending a SAR today referencing this with my 'no' letter as I agree with others that have written regarding EGG, I feel it was a pre-ticked box, and I was also only in part-time employment. I think they are trying for more time and are maybe just sending out rejection letters so that some will give up. Well I won't be and plan on getting every penny back taken from me. Will keep you posted. Bev0 -

I would not directly reference the pre ticked box in the SAR, just ask for a full copy of the application, set of T and C's for the card, and the T and C's you allegedly agreed to for the PPI
Also make sure you ask for a copy of ALL transactions (debits and credits) made to the account for the duration-
