    Wonder if you can advise, have received Barclaycard offer today, which part of the interest do I need to inform the tax office about? The 8% only or the refund of interest charged on the PPI Premiums as well?

    Well I eventually received a reply from HSBC re my request and they have sent a blank Midland Bank agreement form with just my name and address on it & nothing else!!
    This is what they said in their covering letter:

    Section 78 (I) of the Consumer Credit Act 1974 requires us to provide " ... a copy of the
    executed agreement (if any) ... ". Regulation 3 (2) of the Consumer Credit (Cancellation
    Notices and Copies of Documents) Regulations 1983 allows that certain items may be
    omitted from such copies, including the signature box and signature.

    Therefore, the copy of the executed agreement we must supply is a copy but need not be
    a photocopy of the signed agreement. Regulation 7 of those regulations also requires us
    to provide a copy of the executed agreement, as varied, where there is a power to vary the
    terms of the agreement, which there is with this card agreement and that power has been
    exercised to vary the agreement, which again is the case with this card agreement.

    We therefore enclose an up to date copy of the terms and conditions applicable to your
    account and a reconstituted agreement form compliant with Regulation 3 of the
    Consumer Credit (Cancellation Notices and Copied of Documents) Regulations 1983.
    Therefore in accordance with this legislation the up to date terms and conditions are the
    appropriate information to produce.

    So, er - what do I do now???:eek: I don't recognize the writing on the form, & as I said there's nothing filled in except my name....there's a box suggesting the ppi with a tick-box, but obviously I don't know if I ticked it or not!! I honestly thought it was a pre-agreed form that I'd received, so I reckon I'm stuffed now, even though I was told by them that I had to keep the ppi to keep the card....:(:(:(
    Oh well, it was worth a try I suppose.....thanks so much everyone for all your advice.

  • Since I was refused claims on my PPI from the Coop Bank in 2005, it has continued to annoy me ever since. I saw Martins template earlier this year & thought I would complete the claims template as I had nothing to lose.

    Sent form off to the Coop, I received an acknowledgement a week later informing me that they were looking into my request & 6 weeks later they said that they were in the wrong & £1250 would be credit to my account.

    So I would like to say a Big Big Thank You to Martin & your the team

  • I have read most of these pages but i have a question to ask - sorry if this has been asked already (very likely!) i dont have time to read 100s of pages lol

    Is there a template that i can use to send to my credit card companies to recover my PPI charges? I have 3 credit cards and all 3 have PPI on them, i was told one would cover my card from fraud and i also didnt know one ever had anything on it and one i didnt even ask for it.

    this is my first time on here, i am thinking of making a claim for credit card ppi, i have had my card since the early 90's but i have no paperwork apart from recent statements, the thought of tackling the bank seems daunting so i have found a company that charge 17.5% + vat, i have not signed up but i am wondering if anyone has any recommendations or ideas, im not sure what do ?





    it's so easy to do it yourself bonzo, i've used a claim company before you don't know whats going on with them half the time, we'll help you to do what is necessary on here and we won't charge you a penny for it.

    Maybe I should charge Lloyds £15 for the day I made my claim and then £6 for every day they have taken plus 8%.

    It's soul destroying emma, we've all had this, my hsbc claims have been in since last october,havent heard a thing the banks are not as you rightly say very quick on returning your money,i'm sure though that the bank would have rejected your claim by now,as our man marksman says,take it easy and be patient it will get sorted out positively i'm certain of that. I'm sure there is going to be lots of positive activity on here soon,i would'nt be at all surprised if the banks don't just pay out on the remaining claims this month as they've simply ran out of time to sort them out now
