    after a long time thinking about it i decided to follow MSE advice and write to Brclaycard about the PPI i USED to pay on my credit card. i have had the card since 2000 and paid PPI for quite some time before i decided to cancel it.
    i wrote to them on 07/07/11 requesting a copy of my credit agreement and sent a £1 cheque along with the letter requesting a reply within 12 working days.
    no reply in those 12 days so decided to look up on their website how long they normaly take and was suprised to see they take 16 weeks so settled back to wait.
    so was very suprised today when a letter arrived from them which had the normal chat about the consumer credit act 1974, but the bit that threw me was where it said
    "a copy of the terms of your credit agreement as varied in accordance with section 82(1) of the Act has been (or shortly will be) sent out to you under seperate cover"

    then there was a statement of my account
    followed by

    "we are currently unable to provide a copy of the credit agreement you entered into. We acept that we are therefore prevented from enforcing it with you while this state of affairs continues"

    it then went on to say i should still continue to pay my account as usual and quoted a couple of legal cases and that a "unfair relationship cannot be said to have arisen between us as a result of the fact that we have not currently complied with section 78 of the Act"

    what do i do now??? wait?

    the £2100 that HFC settled as wrongly sold PPI was only for one of the loans the other Loan i was claiming against they have said was sold correctly so I am now going to the FOC with this now i know it was sold wrongly and sold in the samr way as the one they settled??? these places really are frustrating

    any way come November I'll be debt free apart from household bills and the 20ys of mortgage it was a long slog to get there but damn it'll be worth it

    Hi andy i've claimed and been paid out on a misold from 1995 but i'm having trouble getting paperwork namely account numbers for my two credit cards, the bank keep telling me that i had no ppi on the credit cards,i did and being self employed i will find out the info and put a claim in,i think the banks knows this one is going to cost the bank a few quid so they want to act the ignorant,there hoping i'll go away,i won't!

    HI, I would threaten them with the information commisioners office and fsa that will probably get them moving, i'm having this with LTSB now i've now had to do the same thing and threaten them to get hold of my credit card agreements. or of course you could sar them link below which will cost you £10.00 but the bank will have to comply under the data protection act of 1998 the bank then have 40 days to respond,if the bank doesnt respond they are then in default under the dpa 1998,good luck,keep pushing.

    Yes picking up that lloyds are difficult has your successful claim been on a loan or mortgage. I have a few loans with lloyds all paid off now from 2001 to 2006 also mortgage from 2002 that I'm still paying ppi hoping I can claim back as been self employed for 22 years

    Hi andy the reclaim was on a small loan, i'll be interested to see what the sar shows up when i get it,i think LTSB are getting fed up now they've not replied to the last two emails, oh well there not my friends are they, it's business, i know i've two credit cards going back to 1992 a total of 12 years and i've checked the dates for the info they have given me, i was definitely self employed so as far as i can see there definitely misold, when i get the sar it should all be there in black and white, the bank are playing a game of smoke and mirrors at the moment.

    Hi everyone,

    I am in need of some advice, after reading all the successes i have decided to have a go myself.

    I am just sorting through old letters and statements but unsure what to do, I have downloaded the 1st letter asking for agreement and terms and conditions but some of the original companies i had loans or credit cards with have merged ie abbey who is now mbna; so do i send the paper work to the address i have for abbey or to mbna this account is still running.

    also if it has been passed to a different company who do i send it to the original one or the company who now has the debt now.

    last question is there any difference when claiming ppi if it is a loan or credit card or car insurance etc

    The self employment issue is a difficult one as dunstonh on here is telling me technically I am covered but I have claim management people ringing me 2and 3 times a day telling me no self employed people are covered by ppi at all. I earn commission only and my hours of work fluctate every week bet if I tried to put in an unemoyment claim they would not pay out. Was your successful claim with lloyds on self employment only ?
