    Hi kimy i think the fos letter is a standard letter, i have just received the same letter with regard to a morgan stanley/barclaycard i have in with the fos at the moment, can't tell you anything about hfc but i am getting this myself with hsbc now,there tactics designed to wear you down, i've had 3 claims in with them since last october and i've not heard a thing as i always say no news is sometimes good news,stay strong.:)

    I have just been made an offer from Tesco Credit card which is great, but they say they don't keep records older than 6 years and can only pay the 5 years prior to that if I have statements.
    I don't, but are they being truthful, surely they should know how much ppi has been paid?




    HI heather you could always sar/cca them, i'd give them a call telling them that people are claiming back 15 years worth of misold ppi/interest, me included and see what they say

    Hi, just checked my emails and received one from the FOS stating that HFC has not come back to them on my claim but they have advised the FOS them they agree to let them know that no later then the end of August whether they are going to uphold complaints or not, l will just have to keep my fingers crossed mine is one they uphold

    same as mine i had a rejection when i put the complaint into barclays re the morgan stanley card but i got this same letter from the fos re my barclays claim, mind you i havent got the same letter yet from the fos re my cap 1 claim so maybe there is some credence in it. stay strong and focussed your nearly there now,the banks are going to have to have a good reason to reject now with the new fsa rules that up until now the banks have refused to follow.:)

    Financial institutions only need to keep records for dorment accounts dating back 6 years or less.

    Any dorment account details over 6 years can be destroyed I think.

    hi i am still awaiting a reply to my comments sent in an email last week re my claims for misold ppi on 2 credit cards held with you in the 1990's, i have been told by your customer service team that i will receive the account/card numbers of all credit cards this week ending friday 05.08.11 i am also still waiting on your dsar team forwarding the sar information i have requested,i am now being told that unless you have a signature this will not happen. I have informed the dsar team that under section 7 of the data protection act it says nothing about having to provide a signature to appropriate a sar request,i have sent identification to the dsar team so they indeed know i am who i say i am and will expect this information shortly,failure to recover the aforementioned information will result in myself putting an official complaint into the fsa and ico,i would rather not have to do this as i have no personal animosity towards your bank but if i have been misold ppi on my credit cards and i know i have, i am entitled according to all the laws of the land to reclaim it, let me put it this way if i owed you money would you let it drop?


    That's the way Cappo, stand your ground :T:T well done, this should give them the push, there is something not right if they do not comply to this.

    Dear Sir/Madam,

    I am still awaiting a reply to the comments I sent to you last week via email with regard to my claim for misold ppi on 2 credit cards held with you in the 1990's

    I have previously been informed by your customer services team that I can expect to receive the account/card numbers of all credit cards this week (week ending friday 05.08.11).

    Whilst writing, I would also state that I am also still waiting on the information previously requested via a correct and lawful Section 7 data Protection Act request - your DSAR team are now stating that unless you have a signature this will not happen.

    I have informed the DSAR team that under section 7 of the Data Protection Act 1998, no reference is made to providing a signature and I also take the opportunity to remind both them and you that I have sent identification to them, clearly covering the requirement that the data supplier have confirmation of identity.

    I now make a formal and clear statement that failure to recover the aforementioned information will result in a official complaint to the FSA and ICO with regard to your lack of cooperation and failure to meet the legal requirements of Section 7, DPA 1998 within the required timeframe of 40 calendar days.

    Hi heather you don't appear stupid at all a sar (subject access request) is where you put in a general request under the 1998 data protection act for all the information a bank or financial institution holds on you for a £10.00 fee and a max 40 day wait you would find out how much in charges,how much ppi you had etc etc a cca is a consumer credit agreement this is a £1.00 fee the bank has up to 14 days to respond and this is used if you are requesting specific agreements not the full works as it were we have a link here if neccesary but i would call them first,hope this helps.
