    In regards of data, they should send you your details on the account going back at least the last 6 years, some will however send details going back even to earlier years, so it looks like they've stuck to the last 6 years in your case.

    That is not so competant of them is it? sending you someone elses!
    I would still continue to make a reclaim if you've not done so yet and tell them you think the level of customer service is poorly too, explain that you received someone elses data (with their personal details, and you are to contact the Information Commissioners Office) to complain about this.

    To make a reclaim, as long as you have the account number that helps and your reasons and complete the reclaim questionnaire below - step 3. Make a point of you do not remember cancelling either in the further information part of the form. (Wonder if they have got yours muddled with someone elses)?

    Send and keep a copy for yourself as well, and allow 8 weeks for a decision.

    When you requested for your data, was this a full SAR (Subject access Request) where you enclose £10 cheque or postal order?
    They normally have 40 calendar days to comply, and below is the full SAR letter template.
    If you had done this and don't feel they have forwarded you everything then write to let them know, and there should also be details of information of when you cancelled (supposed to be) if cancelled within the last 6 years.

    Evening all,

    If anybody has had a claim with FOS (after being initially being refused by bank) and they have upheld but the bank refused due to JR then e-mail them now!

    I e-mailed Big Ste at RBS to review my case and it took a couple of weeks but it sure saved the time with Ombudsman.

    RBS have now upheld claim.

    Lots of wins by lots of posters recently and it is very encouraging for everyone.

    Congratulations :j sorry to sound a bit naive :( is Big Ste, the guy at Group customer relations. I,ve emailed the CEO and got the usual 10 working days but nothing more....

    Aurum, just ot add if you've not recevied any acknowledgment I'd email him back and ask why, at the end of the day he's the top man, and it just goes to show how badly the rest of the staff must operate if he can't acknowedge emails within 10 days.

    I've had one very quick pay-out from Capital One - within four weeks of writing and that was at the beginning of May.
    However, the initial 8 weeks has passed, and no word from Egg or First Direct, although First Direct have written to me and told me they might now take 16 weeks. I know the banks have been given this extra time to deal with this, but can we still chase them? Is it worth it?
    Also, had a loan that I paid off in Dec 2009, but can't remember if there was PPI on it, and no longer have any details. Wrote to lender, using template from this site, including £1 cheque to ask for copies of my agreement, they cashed the cheque, then initially replied saying they were returning my cheque (!?!) and weren't obliged to give me any details because the loan was fully paid off. I wrote to them pointing out they had cashed the cheque and therefore where were my details, they've now replied, sending me a cheque, and saying they don't have to give me anything, and they will no longer deal with me, I have to go to Ombudsman. Is this right? I just want to see the paperwork and I might be wrong! Do I have to go to ombudsman just to get my original loan details, and if not, can anyone direct me to a letter template?
    Sorry this is so long, but wondering what to do! Thanks all.

    After many phone calls i had to finally make the choice to declare myself bankrupt as i could no longer pay any bills. This basically sent me further into a spiral of deperession which i am still taking medication for today. I didn't work for more than 2 years and now can still only cope with part time work.

    Could i claim the PPI payments back? I do have the account number for the loan but no paperwork as the Insolvency service took all of my paperwork.

    Your advice would be gratefully recieved and sorry for rambling :o

    Hi all, just to let you know how it all went, after the initial 8 weeks after putting in my claim Egg wrote to say they were still investigating. I decided to allow them another 4 weeks before going to the Ombudsman. At the end of another 4 weeks i phoned Egg and was told my claim had gone to the Calculations Dept and i should hear something within about 10 days. Anyhow this morning i received a lovely cheque for £800.82! Amazing! thank you all so much for your advice. Keep up the good work and good luck to others who are still waiting :T

    Hi there

    I would sit it out a little longer in regards of the extra time given, they may still get back before the given extra timescales.

    If the account is closed this tends to be the case of them not sending the agreement, but if you request a SAR (Subject access Request), they MUST comply to the DPA (Data protection act), and send all they have on the account going back at least the last 6 years, with a one off payment of £10 cheque or postal order. (You never know the copy of the agreement may even turn up in that).

    However, even if they do not supply you with the details you can still make a reclaim. (although it would help if you know if you did have PPI or not) the SAR should actually enclose these details of insurance even if they don't send you the agreement, but other paperwork enclosed should clarify.

    So basically for more data its the full SAR request if you want to do this.;)
