Hi Again, Seems like a few of us have had the same problems filling in the flyers. I'm not sure if I was contacted or not by a salesperson after comleting the application, but I did have a pre-existing medical condition. (sciatica) Should I still go for it. I assume they would not pay out if I was off work with this problem.0

If you have your reasons for being misold on either one or more counts put a complaint in, capital one have not been given an extension by the fsa so must give you a decision in 8 weeks or information that tells you you can refer your case to the fos, i do not know whether sciatica is or isn't covered but if they reject your claim i'd then contact the fos,good luck.

Hi chris it just depends if you accepted this as a full and final settlement and ge money have the paperwork to prove that you did,it's a grey area as they did give you a refund of sorts, It sounds like nowhere near as much as you should have got,can you tell us a bit more about how you settled and we can all advise you a bit more

Thanks for responding. In terms of settlement, we had a secured loan and originally I complained that I never signed up for PPI, GE Money provided a copy of a signed page where the box was ticked (I never do this) but assumed I didnt have a leg to stand on at the time. When the house was sold as part of the divorce settlement the secured loan was cleared in full.
I was aware I could reclaim some PPI monies but it wasnt until I actually went to claim it that they told me I could not claim full amount as I was outside the 36 month reclaim window and would only receive 7% of the original . I was unaware there was a 36 month window and did complain verbally on the telephone. However I did write and indicate that we were actually in the 36 month therefore I was entitled to 20% (which they had told me on the phone). They did agree and paid the 20% (£1100) which I accepted and that was the end of the matter until all this PPI reclaim came to the fore and I began to wonder if I had been done!
Obviously I was, but can I reclaim any additional funds if I accepted their offer of settlement previously?

I would give them a ring and ask where your card info is, you paid for this.0

Hi All on monday i had a box delivered with about 2000 pages of stuff from Lloyds after i emailed them to say i had not had anything sent to me about my credit card.They have sent loads of stuff but there is no copies of any agreements regarding loans or credit cards are they supposed to send copies in a SAR request. Have emailed them today asking for copies under the SAR.

That is what annoyed me with Lloyds, despite the SAR requests, they did not send mine with the SAR and because of this I had to request for this separately, for a £1 cheque/postal order.
Some will enclose copies of agreements within SAR requests others may not.
You can either contact them here below just to make sure....

I think i'd be inclined to contact the fos now chris as it is a tricky one,i would have thought you could go back to them again and this i would have thought would be your moral right,i don't think it works that way unfortunately in law though, personally and i don't want to misinform you but i think it would be classed as settled now but i would certainly take advice on it.0 -

I've been reading about reclaiming PPI for a little while now and finally got my act together to send off for the t/c for my egg accounts (2 cc, the balance of one of these was then converted into a loan iyswim), tesco card and BOS loan. Anyway I didn't get anything back so decided to go ahead and fill in the questionnaire for one of the cc and the loan as I had evidence of paying PPI for these.
Today I've received the t/c for the 2 egg cards, one from 1999 and the other from 2000. In the t/c for the cc from 1999 there is no mention of PPI but it was showing on the statement that I found for that account. With the other t/c, which was an Advantage card powered by Egg, it does mention PPI but it doesn't mention how much or even how you qualify etc but I can't find any statements to prove I was paying it - but it does look as though I would have been.
My query is this, should I put in a SAR for the 2000 cc account before I put in the questionnaire or should I just go for putting in the questionnaire based on the fact that it is mentioned in the t/c?
I'm sorry if that's a bit long winded but I found it very difficult to explain. I only hope that with all of your experiences someone might be able to clarify things for me.

personally i would sar them first as then you will have the relevant information to fill in the questionaire form,good luck.0
