It does not matter if you signed the paperwork knowingly and willingly,
If you did so on the basis on what you were told, then you have been mis-sold. Do remember that Capital One were fined £170.000 by the FSA for dodgy insurance AND they are still at it, you now need to know 100% that you were not mis-sold and as they say they record phone calls, ask for that transcript. I'm afraid that Capital One are back street traders in the banking busines and not a company to deal with, they cannot be trusted. ASK THEM TO PROVE TO YOU THAT THEY DID NOT MIS-SELL THE POLICY ???
They did, they have done it to countless thousands of people, they are overdue another fine from the FSA
I filled in a flyer that fell out of a magazine in 2003 so there won't be any transcript of a call. Hi first time using this site and not really sure what I'm doing. Hopefully all will be able to see this. I've had a credit card with Capital One for the last 8 years. I have PPI on the card, but it was one that was sent to me as junk mail through the post. I completed the form and he ho was accepted. Didnt think I would be. I think I ticked the box for PPI cover (mainly because I didnt think I would be accepted if I didnt). Whats the chances of my claim being upheld. I didnt know there would be exclusions.

I'm in exactly the same boat as you. In my case, it was a "test" in a way to see if my credit rating had improved after my debt-ridden ex- had left me - I never expected to get accepted (not that the card hasn't come in useful) as I was on a low wage at the time, so thought because of this, if I didn't tick the PPI box I wouldn't get accepted. So far they've told me that this means it wasn't mis-sold (I got a letter back yesterday). The nice bods on here encouraged me to claim, which I did, but now I need to take it further as they're refusing to pay-out. Recurring theme here, on those nice rogues at Capital One...I too filled out a flier which was in a magazine, seems a few of us took that route!
I also had a loan with them, ( settled now), but that was because I got a flier from them, saying that they wanted to offer me one!
Busy, weren't they..it seems their default position is NO, final response, thats it, go away, and judging by the adjudication in their favour, seems a smart move! Bandits, aren't they?:mad::mad:0 -

CAPITAL ONE AGAIN
Just because you ticked the box means nothing. They are/were obliged to ensure that the PPI is right for you and your circumstances.
If you have the PPI policy, read it carefully to see if its applies to you 100%. It probably does not so tell them so.
If you were contacted by a salesman, mostly happens with Capital One,
did he ask about your circumstances, IE being employed, self employed etc etc. If none of this happened then you were not sold a policy, they just added it your card. Ask for a copy of the insurance as Capital One have a bad habit of only sending out the policy after you complain0 -

Mine was exactly the same a flyer through the post,if you have reasons for being missold though go for it and put in a claim and of course theres always a possibility that cap1 will have to review there sales process as under the root cause analysis clause in the 10/12 assessment of the fsa open letter firms can be held to have to investigate if they had a significant amount of sales made the same way and cap 1 were fined for selling 50,000 policies with no documentation explaining what the exclusions were so it is possible that they will have to follow the root cause analysis route and review a lot of sales before the fsa regulated them,even though they were regulated by the GISC at the time they were still required to act fairly.0 -

Take no notice of the final letter lark, just keep on at them.

They are exactly the sort of outfit BBC Watchdog or the media could explore for months! Would really like to see them issue the same sort of promise as Barclays!! Ha!! I must be dreaming....:rotfl:0 -
hi all this is the first post for me so sorry if i have done this in the wrong place i just need a couple of questions answered for me to help me with my reclaim
I have just got my T&C back from MBNA for a credit card i had and i did have ppi on it but on the box to tick if you wanted ppi i ticked NO but it was still added to my card and i paid it for years
has this happened to any one else ?
Do i used the same form to reclaim it back as it has no option for this

if it was added to your card without your express permission and more importantly your tickbox was not ticked you would have a very good claim,in the first instance contact mbna and put in a claim, you could download a fos questionaire and fill it in, check the additional reasons for missale on the thread below and away you go,best to fill in a fos questionaire now it should speed things up. oh and yes they've tried it with a lot of people.
