    Halifax have just wrote to me and advised that they are looking into my mortgage plan and well as the bill protector! so thats something at least!! so today my nightmare company are natwest!!

    I have written to Creation querying the purchase of 3D insurance - they have replied that as far as they are concerned it was a `non advised` sale and up to me to have queried this before now. The card was taken out in a store and i do not remember the shop assistant that signed me up for the card mentioning this at all. Creation say that due to a `system anomaly` they are unable to retrieve a copy of the original application.
    Any help as to where I stand now pls - should I now go to the FOS if I have a case.

    has anyone had problems with 6 month rule? I referred my case to the ombudsman but did it over 6 months from the last reply from Nemo loans. I could kick myself but was busy and time goes on

  • We took out a loan with First Plus in 2003:

    Loan amount - £50,000
    ppi amount - £12,245
    length of loan - 180 months
    is it a settled or unsettled loan - settled in 2005
    monthly amount payable - £616.31 (including ppi payment)
    interest rate - 0.716% per month
    apr - 8.9%
    Loan start date - 01/08/2003

    When we settled in 2005 we had to repay £55,000.

    I've sent one of the template letters to First Plus. How much do you think I can claim?

    They are trying to fob you off I think hun, it may be a good idea now to contact the FOS to see what they say about this first, however if the finance company have suggested this then you go for it.

    If that was your first response though, and they have not mentioned anything about the FOS, write back and tell them you will appreciate having this reconsidered, if this case is not resolved you will look into taking this matter further for investigation, good luck.;)

    If you have a good reason, it could have been personal reasons that held you back I think they will still consider looking into the case for you, there is no harm in going for it or maybe ring the FOS.

    However, you could always start the procedures again to see what Nemo have to say about this, even if they get back to say they have already given your final response.

    Is this loan settled?
    If so when, what year?
    There may be other ways around this otherwise.

    I had a case with these and was finally with the FOS, so I would give it a go hun, you may have had reasons that held you back.;)

    Hi Jedi did you have any further communication fromNemo at all after the last response.

    I had same with A and L but I had told them not to put the files away cause I had not finished with them. I then sent it to FOS about 2 days after 6 months. FOS queried and said it was over the 6 months limit. I was able to show them that I had told the lender that I was not going to let it settle.

    If it is the end of your time could you go through court perhaps.

    The above link gives further info on how PPI was mis sold and there is also a template letter, but try to use your own words if you can and obviously with your boyfriends reasons.

    They have 8 weeks to respond in full and so not worry if he receives the first reply that he must have been aware of taking out PPI because he signed and so on, that means nothing and is generally the response we all receive back from them.

    Like me for one, I thought PPI was all part of the agreement and if I cancelled, I assumed the whole lot would have to be paid off if you know what I mean and feel others thought this with their's as well, especially if it was not explained on the sale of this !

    Post by recorded delivery and another letter maybe required if not successful first time round, but if still not successful, they should let you know in the final response about the FOS complaint procedures.

    Does your boyfriend still have all the agreements for these loans?

    If not you can request for them in writing enclose a £1 postal order or cheque payment and they should supply within 12 days of request.

    However they only normally keep details/info on accounts going back only 6 years, but I was lucky to receive documents as from 2001 when received these in 2008.

    Another way to request paperwork (for more paperwork) is to request a Subject Access request (SAR) they should comply within 40 days and send everything they have on your boyfriend, again going back 6 years.

    There is a letter template for this on the thread with details, but with this one you have to enclose a payment of £10 cheque or postal order payment, again post by recorded delivery.

    He has copies for 6 of the loans and we have requested the other copies verbally a week ago on the phone, I have only
    1 statement of a credit card with PPI on it for Lloyds as i think he shredded most stuff like this when he was burying his head a bit to the extent of his debt.
    Its 20 years of loans/credit cards with Lloyds with the next loan topping up the previous one so there must be some kind of record as its a chain starting in 1989 to the present day.
    If we cant get copies of the ones going right back am i to assume we cannot then claim that ppi back then?
    Would it be right to assume that we could only claim it on those copies of the loan policy showing the ppi breakdown?

    I really want to claim this back for him as it would help enormously to pay of the current loan if we did receive the cash back but i also want to make sure i proceed in the correct manner to ensure we do get the ppi back.

    Just an amusing little tale. Have had some loans with one lender 3 in total which have been refinanced. Upheld earlier in the year. Hmm you think that should be paid soon 6 months at the outside.

    Is it paid Noooooooooooooooooooooo:mad:

    Anyway am considering various options here e.g. Complain to FOS to take it further. Court or other ways which I am just thinking about. So wrote off and gave all account Nos of the Loans as the 40 days were up they sent me information back about a credit card. Please!!!! I may have a baby face (not) but I am not that naive. Had to send another letter giving them 2 weeks and mentioned the ICO. Also was able to tell them where all the paperwork was last seen. Had name of the person from the loan company who was dealing with the FOS.

    So am waiting with bated breath for next instalment in this very amusing contretemp.

    Anyway on another note
    My A and L has gone to an adjudicator now after 1 year:T

    Have had some good news Council have now rotovated my allotment and am now able to get to work on it at long last. Time for some double digging and weeding tomorrow. Am having a digging party so got loads of friends up to help.:cool:
