Hi there

I assumed as long as that actual account is settled, then your entitled to keep the refund on that account, tell them this is a separate loan with a different loan number, where you settled in full some time ago, and you wish to receive your refund as you have been deprived of your money already due to being mis sold.
.

Along similar lines - MBNA paid my account balance on a credit card and sent me the remainder. This is also what RBS are doing with my NatWest card.

I thought that if you had never missed a payment or been in arrears at all they would pay the PPI refund to you directly.

I only ask as I have three complaints in with Barclaycard for before the cut off date. 2 are loans, one of which is ongoing. I had assumed they would refund the PPI and take the PPI component off my monthly repayments. I would like to clear all my credit cards first and then, if enough left, clear my loans, one with Natwest and one with Barclays.

So far have cleared 3 credit cards and some off Barclaycard with reclaimed PPI.

Hi there

I was trying to search the claim form for someone the other day from the FSCS site, and either missed it but could not find it.
However, when I made a claim through the FSCS - different company in default they send me this in the post.
If your having problems, I would personally call the FSCS or maybe ask them to email to you otherwise.
Good luck.

Well I emailed them lastnight and this was the response I got back to day.

Dear Mr Sykes,

Thank you for your email on the 14th June 2011.

Our Ref: WFSLXXXXX

As you may know, Welcome Financial Services Limited (WFSL) was declared "in default" by the Financial Services Compensation Scheme (FSCS) on 2 March 2011. On behalf of the FSCS, WFSL is making arrangements to contact claimants who were sold Payment Protection Insurance (PPI) by WFSL on or after 14 January 2005.

I have traced your account on WFSL records and have arranged for an application form to be sent to you. This will arrive by post as we are unable to operate via email. On receipt of your fully completed form we will endeavour to progress your claim quickly and efficiently.

I look forward to receiving your form however if in the meantime if you have any further queries, please email us on claimanthelp@cattles.co.uk or contact our customer services team on 0845 373 0386

Hiya hun

I still have an ongoing loan with Lloyds, and will be receiving the refunds on the 2 they recently upheld, directly in my bank, as these were loans from 10/11 years ago.

So maybe every bank works differently I don't know that for sure.;)

RBS contacted me today by both letter and e-mail. They pretty much say the same thing:

Dear ** *****,
Thank you for your e-mail dated 13 June 2011.
I sent a letter to you yesterday, which you should receive today. Since the judicial review, we've been speaking with the FSA about making sure we give every case the time it deserves and have agreed with the FSA that PPI complaints put on hold during the judicial review will receive a decision by the end of August 2011.
That said I have asked that your complaints should be reviewed as priority and for that reason I would expect you to have an answer in July 2011. Unfortunately I cannot give a specific day, although work will begin to review complaints within the next two weeks.
Yours sincerely

**** ******

Not satisfied with that really so have fired this back which is yet to be replied to:

** *****,

Thank you very much for e-mail. I will await the letter in the post.

Regarding having to wait until July 2011 for a response, I can totally understand the workload RBS are currently experiencing. Also, I apperciate that this is not directly your fault but however I do a have further query.

When the PPI complaint was originally submitted in August 2010. I received a receipt of acknowledgement after two weeks letter. An 8 week deadline was then set. After 4 weeks I received further correspondance to state the complaint was still being investigated. At the eight week deadline, a letter was recieved to say that the case had been put on hold and a decision would be reached after the JR. The JR was 20th April and the BBA decided not to challenge this at the end of April.

Therefore, can I ask what was happening during that initial 8 week period because all the information sent to me indicated that the case was being investigated, and if it was not then this is misleading.

" At the present time, I am continuing to gather information about your case, so that I can send you a full reply. This means I have not yet completed by investigation....." Mark Bayliss 15th September 2010. (Four week letter)

If my case was being investigated as the letter indicates then surely a decision can be made within days.

As I have said I appreciate the effort and time that you are putting into help me with this query. I do not want to have to go FSA, due to time and all parties additional costs, and I would prefer to reach an amicable solution.

I very much look forward to hearing your response.

Kind Regards

** *****
What a good response? :TIf they had been investigating complaints you would've of had a decision by now. Keep us posted !:)

Hi there

Well basically to reclaim its rather straight forward really, some will cover for self employment and others do not, so if you don't have the copy of the policy booklet details, ask the bank to send you these in the post, they would have to be a copy of the terms and conds at the time you taken the policy out, and they should provide them on request free of charge.

What time do we have if a courier delivers "to read and sign" etc, a lot have been in this situation and its all a time consuming situation, a load of rubbish if they expect you or anyone to read thoroughly before signing, and the wording on these are not always simple either.
If you believe you have a case, there is no harm in giving it a go, lots have and have been successful and the banks must NOT discriminate you for doing so, your only doing what you rightfully should be doing if mis sold.

Check below for more details, and step 3 is the reclaim questionnaire, give them as much info as you can, and send to the ones who sold you the account, the head office or complaints dept.
Keep a copy for yourself as well, in case you need to refer back to it again at some point.
And allow 8 weeks for a decision, they will let you know if they require more time, also due to backlogs of catching up to do from even last years reclaims.;)

Hope this helps, ask for more help if required, good luck.

If you were self-employed you could'nt have claimed and would only possibly be covered for accidents but you would'nt be completely protected as you could'nt be made redundant when you were not employed.
