Hi all, this is my first post and I was wondering if anybody could help me out with some info.

Firstly, thanks to this site I've successfully been awarded a refund of £446 from Egg for mis-sold PPI on my credit card and I have other ongoing cases which I'm fairly confident of winning also, as I'm doing so with the help of the FOS. But I was wondering about a similar policy I have on my mortgage, Total mortgage protection plan from Halifax. Is this a similar scenario as with the mis-sold PPI on my credit card and would I be entitled to claim this back also, as I'm self employed (which was the reason Egg refunded the £446)?

    Any help greatly appreciated, Matt

    Hi Matt

If you believe you were also mis sold on the mortgage protection you can also try to complain and reclaim from them also, have you still the terms and conditions for this mortgage policy?

very interesting, to read di, thank you for bringing it to our attention.

Just wanted to add to this because i have had ppi claims settled as goodwill gestures for RBS and HFC bank. Please Make sure that in the goodwill gesture they specify that they will be refunding you with the same as what the FO will offer which is: Full refund of all PPI paymnets made, Full refund of the interest incurred on the payments made and 8% statutoty interest per annum on the sum of these amounts.

If your goodwill gesture offers the above it is the same as the FO settlement so go for it. Dont accept less as per the article.

Just to add i got the money off RBS last week, id like to say it was straight forward but it wasnt. They stupidly paid it into my old bank account which is closed!! And the amount of PPI refunded to make the loan as it would be if no ppi was ever charged, they are trying to scam me. I got a loan balance Nov 2008 saying £840. The PPI letter refund said the loan account would be credited with £650. I checked my balance at the weekend and they says its not £649!!! Do the maths 840-650= £190. Where does the £629 come into it. SO im on another mission now kicking off they are trying to rip me off again.

Beware- check they apply the refund correctly

What date did you put the claim to the FO and how long has it taken from being appointed an adjudicator to make a decision?
    Thanks

    Hi Rosie

This was submitted in June 2008, I received a phone call from the adjudicator in September 2008, at the time I assumed it was fast tracked but he said no not at that stage, but he ended up with my complaint to deal with.

Lloyds did not agree with the adjudicators view, so this was passed on to the adjudicator that works closely with the ombudsman at end of Jan 2009 this year, it was only fast tracked at this stage due to some change of circumstances when my husband lost in Job in Dec where arrears occurred and other reasons which I am unable to write on an open forum.

My first case was 14 months from start to finish (nemo personal finance) not fast tracked.;)

Hope this helps, everyones varies and I have heard that more adjudicators have been taken on over the last few weeks to help get these complaints moving on quicker.

I have been claiming for a mis sold PPI from Lloyds TSB. It has been to court once when the Judge asked me to submit a statement as to the events of the day I visited the bank and took out the loan, which was several years ago but I have tried to recollect to the best of my knowledge. This has now been sent to the court and I have to go back on Monday 9th March. Lloyds sent a representative last time so I presume they will again. Can anyone give me any advise re court hearing. The PPI was mis sold on medical grounds as I was not asked about any pre existing medical conditions.

    I still have the conditions booklet, which does mention some aspects of being self employed. It states;

"If you were self employed and wish to ake an unemployment claim, your business must:
Have stopped trading and/or be in the process of being wound up; or
Be put into the hands of an insolvency practitioner; or
be in a partnership which has been or is in the process of being dissolved.
Your unemploymnt must start after a continuous period of six months self employment.
If two periods of unemployment are separate by three months or less we will treat this as one continuous claim but we will not pay or any time you were working between these periods. If two periods of unemployment are separated by more than three months, you must return to work for a total of six continuous months before you can make another unemployment claim."

It then goes on about searching for work with "job hunt advice books".

This doesn't seem to promising to me for a claim but I don't really know?
