Has anyone tried claiming from Skycard for their "payment break plan"?
I didn't have a problem paying it because I thought it was a ppi but having just lost my job I've found out that it isn't a ppi and they will only freeze my debt rather than make payments to it while i'm out of work, it's something that wasn't explained properly to me at the time otherwise I wouldn't have bothered with it.0 -

I am not really sure on this but have you still got the terms and conds of this payment plan?
Otherwise ring the financial ombudsman service (FOS) who may be able to tell you more on this, good luck.;)

so their calculation is correct.I was unsure as to what I should do. I was, as I`ve always been ,over cautious,so now I will sign their acceptance form, is that correct?

Claims management businesses warned about misleading marketing claims
Businesses that mislead the public by claiming they can arrange for unpaid loans, credit card debts or other consumer debts to be written off have been told to stop or face action Justice Minister Bridget Prentice said today [17 February 2009], as new guidance was issued by the Ministry of Justice.
The guidance highlights misleading statements in adverts making dubious claims or leaving out important information which might breach consumer protection regulations.
Businesses making these statements could face enforcement action by the Ministry of Justice which might ultimately result in authorisations being removed.
Justice Minister Bridget Prentice said:
‘Vulnerable people facing debt problems need help and support. We have produced this guidance to protect innocent customers from being misled by businesses advertising easy and quick arrangements for outstanding loan, credit card and other similar debts to be written off and compensation to be obtained.
‘We would urge anyone who is considering using a business offering such services to think carefully and seek independent advice before making any final decisions.
‘This guidance is also an important reminder to businesses about the need to comply with rules on advertising and marketing and provide an effective service to their customers.’
Welcoming the new guidance, Ray Watson, Office of Fair Trading (OFT) Director of Consumer Credit, said:
‘The OFT will not hesitate to take enforcement action against licensed claims management businesses who engage in unfair business practices by deliberately misleading vulnerable consumers about the services they offer. Businesses should also be aware that if they offer debt counselling or debt adjusting services without holding an appropriate licence, they will be committing a criminal offence and risk prosecution, and that any agreements they enter into with consumers whilst unlicensed may be unenforceable.’
The guidance is aimed at businesses offering claims management services for unenforceable agreements. Claims management businesses authorised by the Ministry of Justice have also been warned that when advising about the payment of debts or on rescheduling debts, they will need to be appropriately licensed under the Consumer Credit Act 1974 by the Office of Fair Trading.
This action follows on from the consumer alert the Ministry of Justice and the Office of Fair Trading issued in August 2008 urging consumers to seek independent advice before accepting the services of businesses claiming that they can arrange for outstanding balances under loan, credit card and other consumer credit agreements to be written off and secure compensation.

Hi di3004, thanks so much for your reply. We don't have a copy of the original paperwork (OH's ex wife has it somewhere and they are not on speaking terms) We have copies of the paperwork he signed, but I don't believe it's everything to do with the loan and PPI itself. I will ask him to try and get hold of the original agreement in full for our records and go ahead with the second letter with the extra info about the appointment he made etc.
I knew it was a standard reply they sent him, but to deny he ever tried to make contact about the PPI is ridiculous. Am hoping that a copy of the card he got at the appointment, the address of the branch and part of the email he sent talking about the appointment a few days before he went will be enough to kick them into gear to look at things again.
Long old process but will keep you updated on how we do.

Yes Dreamer--all the figures are ok and presented very clearly by A & L for accepting re a mis-sold PPI policy.
However, as your PPI policy is only for Life Cover and not Life/Accident/Sickness & Unemployment-then it is only an extra 5.32% rather than 20-25% which is quite common.
However, only you can decide if you wish to terminate it, or retain the life cover for an extra £9-ish per month to cover the balance of the main loan.aka Calculator

Hi all, this is my first post and I was wondering if anybody could help me out with some info.
Firstly, thanks to this site I've successfully been awarded a refund of £446 from Egg for mis-sold PPI on my credit card and I have other ongoing cases which I'm fairly confident of winning also, as I'm doing so with the help of the FOS. But I was wondering about a similar policy I have on my mortgage, Total mortgage protection plan from Halifax. Is this a similar scenario as with the mis-sold PPI on my credit card and would I be entitled to claim this back also, as I'm self employed (which was the reason Egg refunded the £446)?

Just received an email from the Adjudicator, Lloyds TSB agreed with the Adjudicators view and is refunding all PPI, plus interest and Charges etc, as if PPI were not taken out.....yippeeeee, so no waiting for the ombudsman now :T .
Thanks to all who helped me, Marshallka, Max, Pinknico, Dreamer and everyone else who got me through all this.:beer:
I will post the figures when I have them, so I know for definate the amounts.:D :beer:
