I need your help. I requested Halifax for my Credit card agreement. I paid off this credit card in July 2004 but this morning I received a letter from them saying that as the account has now been closed, there is no longer a regulated agreement between ourselves and therefore they are unable to provide me with the requested documentation.
Di3004, what do I do now? Do I go to FOS? I have already got another case going on in FOS. Another question is, do I contact the same person dealing with my case or do I start this one as a fresh case and deal with a different person who answers the phone.0 -

I'm not too bad thank you, hope your well too.
That's the thing when the account is closed, they don't always hold the agreement details, but you can still continue to make a reclaim, I have on some of mine without the agreements but know ppi was added because they always added it automatically.
So you could continue to make a reclaim if you've not done so already, if you have already done this and they have given the final decision on your reclaim complaint and your not happy with it then yes you can complain to the FOS, but it will have to be done separately.

just reciviced correspondence from mbna ref a loan we took out in oct 2005 with ppi sent complaint in they have responed by telling us they are unable to provide us with a final response at present due to the result of the pending legal proceedings between the bba and the fsa and fso is this claim subject to the judicial review or are they just trying to delay the claim for as long as they can. any info on this would great many thanks glen0 -

Good luck on your reclaiming.
Lots are in the same position at present, but hopefully there will be more news on the JR decision over the next month or so, fingers crossed.

hi have also have done a claim to natwest will they send us the same letter or will they issue a final responce i have had correspondence saying they are investigating the complaint. this claim was sent before the one to mbna i've had to letters from natwest one asking for the main account holders signature to be verfied0

Hi all,
I haven't replied to this discussion for a while due to a few things but my PPI complaint is in the final stage with the FOS.
NOW I see something BIGGER which the Adjudicators have ALL missed completely.
In October 2009, I had a complaint with EGG UPHELD and they paid my Insolvent Practitioner £ 2020.01 as a PPI refund ( £1516.00 and £504.01 interest) INSTEAD of £3797.97 & £551.30 interest.
I complained and went to the FOS.
Since then, Egg did NOT take off the £2020.01 from my loan, BUT THE REMAINING AMOUNT OF MY PPI was taken off my loan but they did NOT pay my IP this amount which is £2281.97.
They then ADDED £384.72 to my loan as accrued interest and then sold it on for collection.
My point is this : Egg have committed FRAUD in a BIG WAY and NOTHING has been done about it.
FRAUD meaning that the £2020.01 was paid to my IP (meaning £500 went to me) but NOT taken off my loan, IS NOT THEIR MONEY, but EGG SOLD IT ON TO A THIRD PARTY FOR COLLECTION. Totalling
£ 10,620.03, it should be down to £8215.31 with my PPI taken off.
A lot of mistakes have been made to my loan balance and Egg owes my IP £2281.97 since October 2009.
It is my IP to sort it out, they have been reluctant so far, but I have written to the Insolvency Service and they said it is my IP to sort it out. My IP will get back to me, but I fear that it won't be good news.
I am writing to the FOS stating this fact.
Egg said that the £2281.97 was my PPI rebate (which should have been paid to my IP as well) was used to reduce my loan balance prior to being outsourced for collection.
Do you think I have a case here ?
Do you think I would get £ 10,620.03 (the rest of my loan including the PPI of £2020.01) back to me ?
Any ideas ?
Any advice is great

It seems to be a mixture of everything at the moment, some are continuing to investigate and others are being held up, my 2 via Lloyds I am sitting out with them, due to the JR, but I am entitled as stated on the letter to complain to the FOS if I want to, but going to see if or what happens over the next month and take it from there.
Some do request for signatures, think there was one that requested for ours some time ago and I sent a copy of the drivers licences, something like that.;)The one and only "Dizzy Di"0 -
