  • hi,thanks for the info & i will hold out till i hear from them again,it is past the 8 weeks & it says nothing in the letter about being on hold and they are reviewing there records in respect of this matter,its a loan i took out with them about 5-6 years ago and me & the wife worked out they will owe me in the region of about 4k,the ppi was part of the loan

    This is my first post, but have been reading / following advice for a while.

    Have been persuing Egg for PPI refund on behalf of wife. Today received a letter from them stating that my complaint has been upheld. However, due to the "juducual review, there is uncertainty as to the rules applicable to how we should calculate any refund in relation to your complaint".

    Basically they are stating that until the final outcome of the review they can not work out how much money to refund!

    I have not seen this scenario elsewhere in the forum, and wondered if anyone has had similar experience and/or what should we do next?

    Egg say we can go to FOS if unhappy, but not sure if this could lengthen the process

    You could give the FOS a ring before you decide on what to do about this, I assumed because its a case they have been dealing with and upheld, then they would still pay out, maybe the FOS will confirm on this one for you, good luck.

    I just want to ask for your advice. Forum Admin, please bear with me if this is not the correct thread.

    I filed a mis-selling complaint of PPI to Natwest during the later part of September this year. I received 3 letters from that time till last week saying that they are still looking/investigating my case.

    Then today I received a letter that says:

    ...You have made a complaint about the sale of your PPI policy.Having reviewed your complaint we can confirm that we are unable to provide a final response to your complaint at the moment. This is because the standards against which your complaint should be assessed, namely the FSA policy statement on PPI complaints and guidance published by the Financial Ombudsman Service(FOS) are the subject of legal proceedings between the British Banker's Association (BBA) and the FSA and FOS. This letter explains why and briefly outlines the implications of this for you.

    In August 2010, the FSA made certain new provisions concerning the way in which the industry should handle customer complaints about the sale of PPI policies. The BBA believes that those provisions are incorrect and that the new provisions go beyond the rules and regulatory requirements in force at the time of the sales.Accordingly, the BBA has sought clarification from the court on that and on a related point concerning complaints handling by the FOS.

    The BBA intends to work with the FSA and the FOS to ensure these matters are resolved as soon as possible. Once that is done, we will have clarification and certainly as to the standards against your complaint should be assessed which will allow us to make a final decision and respond to your complaint.

    In the meantime:
    We have registered your complaint.
    We will keep you informed if there are material developments in the court case that affect your complaint.
    We will revert to you once the matter has been resolved through the court.
    We will not take account of the delay for the purposes of calculating any applicable time bar period either in relation to court proceedings or for calculating any period within which a complaint should be referred to the FOS.

    We enclose an explanatory leaflet about FOS, to whom you now have the right to refer your complaint. The services they offer are set out in the enclosed booklet 'Your complaint and the Ombudsman'.

    Hi scottie59, you have to now send your complaint to fos, include copies of letters sent to you by the bank, and then i am afraid you will have to wait. The first hearing for the judicial review is the 24th jan.
  • Hi Everyone.... sorry its been so long,
    just wanted to update you on my PPI claim....

    I received a reply from the HSBC within the time I gave them, 4 weeks and at least I knew then that they were dealing with the matter.the letter said sorry.... etc etc and they are looking into the matter and will contact me again with a full response as soon as they have completed their investigations.

    They say, to assist them in responding within the time scales set by the regulators they employ external consultants to assess and respond to some of the complaints regarding their products. and since they have received mine I have had 2 or 3 calls from a Financial Solutions Company???? Company name was BAINS and ERNST,soI rang them, I wanted to know where they had got my information from but on ringing them they just told me they buy data from companies to help people sort out debt..... but they would not tell me if data they bought WAS in fact bought from the banks because information is supposed to be PROTECTED by the data protection act.

    Should I contact the bank to enquire where mine and my daughters data has been passed to, I wonder???

    Any helpful hints will be much appreciated.

    Hope your well.

    And good luck on the reclaiming.

    You can contact the bank and enquire, but another thing you could do is request for a credit report, some are free for 30 days, google in some of the companies.......the normal charge for a credit report is £2.

    Equifax
    Experian etc........

    These should confirm what is what on your credit status etc.
