    Update and some advice please :)...So I've got my first success with A&L but I am having trouble with EGG credit card. I took out a credit card online when in 2001 when I was at university and closed the account in 2007. They were charging me PPI without relising. I wrote to egg with the following reasons:

    I now believe that I was mis-sold this policy because I was:


    · " Unemployed when the card was taken out. I was a student working part-time less than 16 hours a week.

    · Not informed that taking the PPI policy was optional. I was not aware I could opt out of the PPI cover on my application.



    · Not informed that PPI had been added to my credit card monthly repayments."
    TTThis is their reply:
    After carrying out a full review of your account, our records indicate that you purchased the insurance through the Egg website on 12 March 2001.

    Our online sales process:
    Does not require you to take repayment protection insurnace as a condition of obtaining the credit card.
    Does not provide advisory service
    Required you to positively confirm that you wished to purchase this policy during the online application
    Provided full terms and conditions of the policy and requested you to read them before submitting.

    OOn this basis we are unable to uphold your complaint and can confirm it has been closed.

    Guys shall I write to Egg again or to th ombundsman? Do you think I have a chance?

    Hi Cheerios

    I think this is very common with EGG online applications, but I take it you cannot remember actually ticking for the ppi?

    I would write back and ask them to reconsider, if this was not the final decision, otherwise the FOS, the fos will see you were not eligible anyway for the policy so where-as it was worthless to you.

    Just a suggestion though, do you have anything to send to EGG to prove you were not employed at the time of when you taken out the account perhaps?

    I am looking for some advice on the following subject,
    I sent a SAR to the RBS (RBS recieved on the 8th October 2010) regarding a c/c ( did not have the a/c number) i had back in 2003 which was settled on the 6th October 2004, i also sent a copy of my experian credit report which stated that the file was updated on the 31st October 2004.
    This morning i have recieved a reply from the RBS stating that as the a/c has been closed for more than 6 years (just by 3 days) they no longer have any information relating to the a/c and have returned my £10 postal order.
    Where can i go from here ?

    if anyone can give me some advice it would really help.

    No unfortunately, I do not remember, it such along time ago...and I guess Egg will play on that.

    I was still at university, unless I ask my university to write a letter maybe? I have my degree cert which shows I graduated in 2002/3...which I can't remember now. Is that enough proof to show I was studying full time?

    It was Egg final decision. I think i will have to write to FOS, do I need to copy Egg in? Also is there any letter templates for the FOS?

    Hi Harry

    How annoying, out by just 3 days!!

    So I take it you still cannot get hold of the account number then?

    Because just as long as you do have the account number - you could continue to make a reclaim, but the other option is to continue with a reclaim, just give them as many details of the loan, anything you can remember, when you taken it out and amount and so on.
    I read on here back about a week or 2 someone had done this and suddenly they came across the information lol.

    Not sure if it was upheld, it may have been.

    But otherwise for more advice on this, maybe the Information Commissioners Office (ICO) will have some ideas, (3 days though):mad:

    I suppose with it being sometime back its not going to be easy to remember all the details lol.

    Yes that would be a good idea if you can do that, do you think the uni will do that for you? it would be very helpful if they can.

    You can always enclose copies of the details to the fos then if the final decision have already been given by EGG.
    There is a complaints form on the FOS site here:

    Complete that and send any copies of evidence you have, and if you need to give further information you can always continue on paper if no space on the form.

    looks like my old uni can write me a letter confirming i was a full time student, I will find out tomorrow. Once I do, I will write to egg again and start proceedings with FOS. I aslo read something about the pre ticked boxes which is not considered to be accepted by the FSA. Apparently, my letter is a pretty standard reply from EGG. My application was in 2001 and I believe they were still using pre ticked boxes. I can see a long fight with this one!

    Hello Di,

    Just spoke to the nice people at the ICO and unfortunately they said as the time lapse of 6 years had just passed the RBS have no reason / requirement to keep records for anytime after this period of time.
    Still as i have the start / finish dates of the C/C and the credit limit imposed as well as the full payment details from my own bank i might as well chance my arm and send off the 1st PPI claim letter as i certainly did not need it as i had PHI from my employers if i could not return to work through ill health.
    What do you think ?
