PPI Reclaiming Discussion part 4

Just to give an update on this saga - it's been going on since 29th May!
I completed the FOS complaints questionnaire and sent it off on 29th May to GE. Eventually got a reply from Santander (who presumably have taken GE over) to say that they did not come under the jurisdiction of the FOS until 2005 and car loan was taken out in December 2004. I asked who the insurance company was and they said Genworth. When I contacted Genworth by phone a recorded message said "welcome to GE Money"! They said that the insurance company was Lighthouse, but didn't have an address. I then spoke to FOS who said Ligthouse were in Gibraltar and they would write to them. Now both FOS and myself have received a letter from Lighthouse referring us back to Santander. FOS now say that they can't do anything as I took the car out in Dec 2004 and their jursdiction came into force in April 2005.
FOS advisor suggested possibility of going to small claims court. She worked out that total PPI premiums paid would have been around £600. Has anyone gone down this route or know how much it costs, likelihood of success in these circumstances etc. Any advice would be gratefully appreciated.0 -

Hi all,
Been a while since my last post as I have been waiting for feedback from GE Money about my PPI claim. The following thread IS rather lengthy but I want to get all details down so that a) anyone in a similiar position can see what's occuring and b) for those of you who can help me as I now in need of advice
Okay so I filed my complaint with them back in August with all the details listed why I felt I had been mis sold the PPI and I filled out the template forms available from this forum and with the help of 'Di3004', 'robbedofmymoney' and 'Amerall' (a big thanks to you all for getting me this far)
I received a letter from them on the 22nd September 2010 confirming acceptance etc and that they would be starting investigations into my claim.
I then received a letter today dated 27th September 2010 thanking me for contacting them and then the following information (bear with me...)
Having looked at the points you have raised, I can see that your complaint concerns the fact that you feel the PPI was mis-sold.
The copy of the credit agreement, which you enclosed with your letter, clearly outlines all the particulars of the finance arrangement. As this is signed by yourself to show that you have read and understood the terms and conditions of your agreement with us I am unable to evidence that any error has been made by GE Money in the administration of your account.
From my initial investigation I note that whilst GE Money provided the finance to you for the PPI, GE Money did not sell it to you.
Because your complaint is specifically about the advice you were given, and because GE Money neither sold this PPI to you, nor were they present at the point of sale, I do not feel we can investigate your complaint fully or fairly.
You will need to contact Active Mortgage Management PLC directly, and ask them to investigate your complaint as they are clearly in a much better position to do so. To assist you, we have forwarded a copy of your complaint to Active Mortgage Management PLC and can confirm our records show their last address to be..........(address of this company that I have never heard of)
If you are unable to contact them, it may be that they are no longer trading. In this case you will need to identify and contact the company Administrators to make any claim. (so why have they supposedly sent them a copy if they are not even sure of their existence anymore??)
If you do not get a suitable response from them, you may wish to refer your case to the Financial Services Compensation Scheme (FSCS), a body created by the Government to assist customers make claims against financial firms that are no longer trading. They can be contacted at (address of FSCS etc etc)
As for GE Money's involvement, I need to inform you that this is our Final Response letter. you may ask the Financial Ombudsman Service to look into your complaint, but you will need to do so within six months of this letter. I have enclosed a copy of their explanatory leaflet which outlines their process.
So, this is where I am now - it does sound like they are trying to palm me off BUT I do feel a little unsure about what to do or where to go from here...especially as they are giving me the Ombudsman details - does this mean they are confident I cannot pursue with them (GE Money)or what?? Any help / advice on where tp go from here would be great and obviously I will post updates as and when they come through....

I have no idea how to post new threads so apologies if this is barging into someone else's question.
I took a loan and credit card out with Egg around 2002. I still have the credit card but transferred the remainder of my loan to Smile.
I had insurance on both the credit card and loan and it was definitely missold to me BUT a few years ago I decided to cancel my insurance. Am I still eligible to try and reclaim the insurance I did pay or does the fact that i cancelled the insurance render any attempts to reclaim charges pointless?0 -
Hello
New to the site so a big hello to all.
Have started to claim back PPI from a car loan i took out with The funding corporation. The PPI works out to be just over £4000.
Have received a letter back today from my first complaint to the company basically saying thanks for your letter and we are dealing with your complaint.
What I am wondering is what can I expect to happen next?0 -

Hi evie
Sorry to hear this and of all the running around you have gone through.
I have not actually gone through small claims, but I am aware that someone else that are going this direction, which is being arranged through the local CAB, I think this the cost of this was about £80 but it may vary depending on how much your trying to reclaim.
The CAB will advise you free of charge.
I would give them a call.
Fingers crossed Evie.;)The one and only "Dizzy Di"0 -

Hi Steve
Your very welcome.
Right, it is normally those who arranged the policy is the ones you pursue, so if they have confirmed its that of the company of whom they gave you details of, then I would try to write to them or ring them if you can get hold of the details, to make sure that GE have sent you details.....
If these are them as below then they are in liquidation, but make sure its the correct ones first by checking out the company number, GE should give your the company details of the business they gave details of to you......but I have found these here which prove they are in liquidation......
Name & Registered Office:
ACTIVE MORTGAGE MANAGEMENT PLC
TOMLINSONS ST JOHNS COURT
72 GARTSIDE STREET
MANCHESTER
M3 3EL
Company No. 04063387Status: Liquidation
Date of Incorporation
So if this is the case, you then need to contact the FSCS, and ask if this company are listed with them, if so then they will arrange to send you a claim form through the post.
http://www.fscs.org.uk/contact-us/
Any problems, and they cannot deal with your claim (in case they are not listed) then contact the Financial ombudsman service (FOS) and ask on your best direction to take from here.
http://www.financial-ombudsman.org.uk/contact/index.html
You could contact the FOS anyway and ask for advice first if you want to.;)
Please keep us informed Steve, and we can take it from your outcome.
Good luck. The one and only "Dizzy Di"0 -

Hi and welcome
You are in the correct part of the forums so no worries.
You make the reclaim to the ones who set up and arranged your finance from the start.
You do this by completing the reclaiming questionnaire as shown on stage one of reclaiming here:
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#reclaim
Keep a copy for yourself as well in case you need to refer to it at some point.
They have 8 weeks in full to give a decision, but may ask for more time to investigate your complaint.
I would also post by recorded delivery as well, this is your proof of posting.
Good luck.:)The one and only "Dizzy Di"0 -

Hi and welcome
Good luck on your reclaiming.
They have 8 weeks to give a decision, sometimes they write to ask for more time.
Hope you receive a decision in your favour very soon, fingers crossed, and please keep us posted.:)The one and only "Dizzy Di"0 -
