Hello again! About a month on from my first couple of posts and I've just received the information about my account from the Halifax - SAR letter worked! Some of it dates back to 1998 (the date the account was opened) and it consists of some statements, lots of screen shots and database listings of things like changes of address, missed payments etc. which should be useful. As I've been out of debt for four years now having this stuff in the house again has made me uneasy but I've got the questionnaire ready and I'm going ahead.

I estimate from looking at a few of the monthly payments that I paid around 2000gbp in PPI over ten years, although I'm hoping I don't have to calculate this accurately as I don't understand much of the paperwork. I gather that the paperwork will be required at the Ombudsman stage?

I'm still waiting for a reply to the SAR letter I sent to Santander.

    Hi there

    Good luck on your reclaiming.

The paperwork maybe required if you do complain to the FOS, for instance if the business your complaining about does not resolve your complaint in your favour by the final decision, then you only send copies of the paperwork and not the originals.

I assume then you are prepared to make a reclaim with your reasons, by completing the FOS questionnaire, remember to send to the one responsible for the mis selling and keep a copy for yourself as well, in case you need to refer to it later on, or also send a copy of this to the FOS as well - if it comes to this.

There is another form to complete if not resolved, this is called a FOS complaints form, not to get confused with the FOS Questionniare.;)
    Good luck.

Less than 2 weeks after sending off my questionaire egg have sent me a letetr offering a full refund of my premiums paid plus interest,

    PPI Premium on loan £2338.10
Less any PPI premium refund taken off loan £71.57
Refund of interest charged on PPI premium at contractual rate £582.57
    Total refund due = £2849.10

Does this all add up? Sorry not a clue hahah and should I accept? :)

Sorry I did the maths, not thinking straight hah.. just the bit about the less any premium taken off the loan I am unsure of.. is this because the ppi would have been front loaded on the loan.. so my loan will reduce by 71.57 too?

Hi Daz and well done to you!

Yes it all adds up to be fine here.

    2338.10 - the premium already given £71.57 = 2266.53
+ interest amount of £582.57, that then adds up to be = £2849.10.

    Congratulations!

Daz, the amount adds up to be just fine, so just as long as you feel your happy then of course accept, if you think anything is amiss its always best to check on these things first.;)

as this was after regulations of insurance took place in jan 2005 and your broker is not trading you should now be able to take the complaint yourself to the fscs.

you should also be allowed to walk away from your contract with solicitors as it has been dragging for 2 years and changed solicitors etc free of charges regardless of contracts i would think.

Can i ask who your solicitors were and what contract you signed with them. Its actually easy to deal with your complaint now as its with the fscs and if loans.co.uk are declared in default (i have checked though and there is nothing as yet as i can see!!!) and on their register you should be able to seek your compensation that way.

Do you know a date when they ceased trading perhaps???? I know that mbna own them since 2005??? I think they may still be trading actually according to posts on here.

    Domain name:
    Loans.co.uk

    registrant:
    Mbna europe bank limited

    registrant type:
Uk limited company, (company number: 2783251)

    registrant's address:
    Stansfield house
    chester business park
    chester
    ch4 9qq
    united kingdom
    thanks marshallka,
the 3 solicitors are, heenans, james & beckett, and currently black lion law. It is on a no win no fee basis and i never signed into any contract, i have asked black lion law if heenans and james and beckett are owed any money for any work they carried out and they said they couldnt get in touch with them as they had ceased trading. BLACKLION LAW rang loans.co.uk today only after i chased them 1st and they said that they had ceased trading now for 1year , i then explaine that loans.co.uk had admitted liability dec 2009 so they could not have ceased trading 1yr ago
