PPI Reclaiming Discussion part 4

Hi
This is my first post so be gentle!
I wonder if you can help - I took out a loan with Black Horse (BH) Finance and I am convinced that i was mis-sold PPI. I either took the PPI or i didnt get the loan. I was in a pretty dark place at the time and they were my last options so needless to say I took it.
My concerns are that the loan was taken out in 2002 and I repaid it in full in 2006. Given that it was 2002 (and on some postings i can see some comments about it being difficult prior to 2006) and also because I have now settled the loan would make it impossible.
The value of the (secure) Loan was £10k with a £256 monthly payment. Fortunately circumstances have changed for me but the interest rate was very expensive and i have never really forgiven BH for the position they put me in.
I have the policy number from my bank statements but none of the paperwork.
What do you reckon - is it worth pursuing?

I think my bank EGG has committed FRAUD to myself, my INsolvent Practitioner & to the Financial Ombudsman.
I will explain this.
In October 2009, after sending a complaint regarding PPI to EGG, I recieved as a REFUND of £2020.01 out of a PPI REFUND of £3797.97 of a loan of £8901.00
I was NOT paid any INTEREST at all, They kept it which they shouldn't have done. A FULL PPI REFUND is EVERYTHING back to you, under the FSA rules.
EGG did NOT do this. They even lied to me & to the FOS the amount of REFUND I was entitled to. The amount I did NOT get. Even the breakdown of the refund did NOT tell how they got to the amount I received.
I am asking the for the REST of the money.
Secondly, about the FRAUD. I received a letter 3 weeks ago saying that my loan account was sold to a CREDIT MANAGEMENT company for £10,620.03. EGG sent them figures dating SEPT 2008 - SEPT 2009.
How I know this, it is because I have the ORIGINAL ANNUAL STATEMENT dating APRIL 2010 covering the SAME dates. EGG has committed FRAUD.
And also, I recently got over the weekend a letter from them with the WHOLE breakdown of my LOAN and EVEN THAT DID NOT MENTION ANYTHING ABOUT £10,620.03.
It says that the total amount is £10235.32. They DID take off the FULl £3797.97 PPI , then PUT if back ON, They took of the INTEREST of £504.01 and then PUT straight back ON and NOW given me a different figure and taken that OFF. I AM entitled to the WHOLE of the PPI & INTEREST.
WHY haven't I got this ?
We are entitled to the WHOLE of the PPI under the FSA rules, aren't we ?
I have asked the FOS to investigate this and ask EGG to repay me in FULL every compensation including the WHOLE PPI.
Do people think that this BANK has committed FRAUD and do you think I have a case to send them to court ?
Any Ideas would be great and any help is grateful

Hi nickybutch, I have just had another look at your post, the original loan amount would have had interest on top so depending how long you have had this loan that balance you have been given may be right.I will assume that because this debt has been passed over for collection, then you have missed payments (or made reduced payments) these will affect your balance as well.0

It is nice to see that Lloyds TSB have made so much money again!!!!!
Pity they dont spend any of it on their customer care.
E mails sent on the 28th July, 2nd August and again today.
Letter sent 2nd August...................still no acknowledgement at all, have even copied in Eric (loads of money) Daniels.
I wonder if they would be so illusive if it was me owing them money??0 -

Hi and welcome
As amersall says you can make a reclaim with your reasons by writing to them or use the FOS questionnaire in replacement of the first template letter.
You will find the questionnaire - link below - further down the page as stage one.
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
Complete and send a copy to who was responsible for setting up your policy, remember to keep a copy as well in case you need to refer to it again, also as suggested by the Financial ombudsman service (FOS).
They have 8 weeks in full to respond.
Try to post by recorded delivery if you can, this is your proof of posting.
Good luck.;)The one and only "Dizzy Di"0 -
