PPI Reclaiming Discussion part 4

I had a credit card with Goldfish from about 1999 to (I think 2004). I got rid of the card and all the paperwork when I moved home and didn't hold onto the account number. I know that I was mis-sold PPI on the card as it was my first credit card. I wrote to Barclaycard Customer Services whom I believe took over Goldfish requesting a SAR. They have returned my SAR request and cheque stating "There are no accounts for the named customer at the address(es) provided".
What should my next move be?
Also I received a letter from Santander about my Abbey Loan. It's the usual "we will investigate your complaint blurb" but they want me to give them a telephone call. I don't really want to enter into any conversations with them via the phone as I'd prefer everything to be in writing in case I have to take it to the FOS. Am I obliged to call them?
Sorry for all of the questions!0 -

Hi Anna
That is so annoying.
By just having the account number would be good, but I note you no longer have any details.
If you come across any old monthly statements that would be good too, unfortunately some only hold details for the last 6 years and if also paid off 6 years ago the chances are they may not hold these details anymore, yet some do keep them on microfiche, you could write and ask them on this to make sure.;)
The Information Commissioners Office (ICO) will be able to advise on your best options in relation to your account/data, give them a call in office hours and see what they suggest. Good luck.

Me too prefer to keep everything in writing, I would write back and tell them that in regards to Santander.
You never know, they may try fobbing off, just tell them that you would personally request for all communication to be in writing only.
Good luck.:)The one and only "Dizzy Di"0 -

Thank you for the info. Santander sent me 2 letters today. They returned my cheque for £1 saying that "we do not hold such an account number" the second letter I opened was in relation to the same account number acknowledging receipt of my questionnaire. The muppets really don't know what they are doing!0 -

LOL, your right there, they certainly don't know what they are doing, keep them as proof though.;)
Give the ICO a call when you can next week as well.
You very welcome Anna. XThe one and only "Dizzy Di"0 -
Posted already and a newcomer to this site but can't find where my post ended up.
Anyway can anybody say if this company (AIMS) has contacted them (I was cold called) and if they are any good at PPI recovery? They want 25% of whatever I am awarded but is a 'no win no fee' basis.
Is it worth it?
Thanks for any advice.0 -

Hi there
I would not bother using a claims company - its more or less straight forward to have a go yourself, and all free this way, where as you know you pay out if successful by using a claims company, and doing it yourself with free help from this site - you get to keep all your money.
I would also be very wary of claims companies as well, lots have been let down badly by them.
Its always worth checking them out with the Ministry of Justice as well (MOJ).

All you do - if you want to have a go yourself, if mis sold the ppi....
1. Complete the FOS questionnaire (these are quite new questionnaires and in replacement of the first template reclaiming letter), the Financial ombudsman issued these questionnaires.
You will find the FOS questionnaire on the link below - further down the page as Stage one:
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
2. Send to whoever was responsible to setting up and selling you the policy.
3. Keep a copy for yourself - this is recommended by the FOS in case you need to refer to it at a later date.
4. They have 8 weeks in full to respond - sometimes they ask for more time to investigate, that is fine.
If totally ignored when the 8 weeks have passed, then you can continue to complain to the FOS, where then you would complete a FOS Complaints form as found on the link here:
http://www.financial-ombudsman.org.uk/consumer/complaints.htm
You can also do this if you've not had a favourable response by the final decision, cos some will give you the opportunity to write back with further information.
In the final decision letter, the business should anyway enclose details of the FOS with a leaflet - the procedures of making a complaint to the FOS.
With this you also enclose a copy of the final letter from the business and a copy of your questionnaire.
Its also recommended to post by recorded delivery as well, this is your proof of posting.
Hope this helps, good luck and ask for help anytime.;)The one and only "Dizzy Di"0 -

Hello all
Im new to posting on here and appoligies that i am replying as i dont know how to post without replying.
I would like to reclaim the PPI i had with my credit card. I have already paid this off a few years ago, however i did reclaim the charges on the account and still have all the statements.
I am unsure of how to start this as i dont need to contact the bank for copies of the statement. Do i just write to them asking for a refund?
I was self employed at the time and do not remember how i came to be paying PPI as it only shows up on my statements after the balance crept up to a large amount. I think I recieved a phone call asking me to take it out and the sales person was pushy, i was self employed (only other account i had with yorkshire bank was my business account) and i dont remember being asked about my employment.
Any advice would be gratefully recieved.
Thankyou very much to anyone who replies.

Hi and welcome, (lovely username too).:A;)
All you do is complete a Questionnaire to make a reclaim, these are in replacement of the first template letters, and issued by the financial ombudsman service (FOS).

Complete, and send to who was responsible for setting up and selling you the policy, its also recommended you keep a copy, in case you neeed to refer to it later on.
They have 8 weeks in full to respond, they sometimes ask for more time to investigate which is fine.
If they do not uphold in your favour by the final decision, you can then complain to the FOS, they normally enclose details of the leaflet of the FOS on how to complain to them about your complaint.
Hope this helps, I would also post by recorded delivery, for your proof of posting.
Good luck, and any further help please just yell.:)
