Thanks Di, so Endeavour it would be

Well I would of thought so but I would defo try to get more advice on this one if I were you, although the FOS will clarify.

If your unable to go the mis selling route this is another option, and go the unfair rebate direction.

Still get more advice on this first though if you can.

Tiggrae who used to post on here would be able to help on this one for sure, have not seen her here for a while, hopefully she will come along and see your post.;)

'FOS -'If we decide that the way the policy works was clearly explained, we will probably only look at whether the refund has been calculated fairly. But if we decide that the way the policy works was not explained clearly, we will need to consider whether this type of policy should have been sold in the particular circumstances. '

I wasnt given a rebate of PPI nor loan, and was sold as single premium over 5 years when loan was 10. Do you think I should put this in a letter to Endeavour as I have to send them a copy of the letter Central sent me saying they wont deal with it.

Halphy, yes that is actually a good idea.

Tell them you are complaining in regards of an unfair rebate as a new complaint, as on checking you realise you were not given any rebate on settling the loan.
Tell them the FOS will consider these complaints and also mention that this part of it was the responsibility of Endeavour and not the broker.
And of course state you understand at that time they were regulated by the FSA.

Halphy, what year did you settle this loan anyway?

I know its best to be careful how you word these complaints, because realistically you want to keep the mis selling side of it separate to that of an unfair rebate really.

In this case Endeavour may deal with it as an unfair rebate but not take on the responsibility of the mis selling side of it, think you got my drift.:D;)

hi i am claiming back off clydesdale they have sent me letter saying that due to the length of time that has elapsed since this ppi policy was arranged they no longer hold any point of sale documentation. therefore they are unable to find any evidence that the payment protection was ever mis-sold. but they are wiling to give me goodwill
and will give me £100. can anyone tell if i would be better taking this offer or appeal it thanks

Hi and welcome.

Sometimes they do not hold any information if the 6 years have passed, so may I ask when you settled this loan, if within the last 6 years you could try to see if they do have anything held on you by microfiche, by requesting a Subject Access Request (SAR).

More on SAR here:

However, its taking a chance really, and a payment of £10 cheque or postal order is to be enclosed, and they have 40 calendar days to comply.

I am not sure what to suggest on the offer really, have they given you a timescale to accept or not?
