What I mean about the above is if they actually redress by Goodwill then it should be as they say "goodwill" with no admitting liability and by the same breathe the consumer should have the right to not accept it as full and final. They are getting the good of not having anything registered against them at the FSA and FOS so they look like a firm that has fewer complaints against them but they are reducing payouts this way also. If someone has received a goodwill payment then it should not be used if they then decide to actually make the full complaint for misselling and then taken away. I feel sorry for all those that accepted the £750 payouts that one bank was making in goodwill and just after the FSA said that firms had to reopen complaints that were made but I don't think that firms that had made goodwill payments had to reopen theirs. Consumers then lost out.
It was stereo mikes comment here that prompted me to post the above
When an offer is made by the FOS they ask the company to provide details of all claims, arrears, refunds etc so these can be deducted from any redress0 -

front loaded policys are not worth the paper they are written on, they are rip off
go back and tell them you were mis sold and if they dont redress as such you will go to fos, you will only be better off with a full redress, a "goodwill gesture" will cost you thousands in the long term

Some good news :j I have received a letter from one of my PPI claims today " making a full and final offer" for quite a substantial amount( I dont want to reveal this at present in case they are looking on here,:D)( i will reveal it later:beer:)
but i have a querry???? and i need some advice
They have only paid the PPI back as far as 2000 ( this is in my calculations for the amount they are offering) and state that they have no record of any agreement etc prior to 1993.
I have calculated that the outstanding difference owed to me for ppi paid from 1990 to 2000 is another fairly substantial amount and i was wondering has anyone been succesful in asking for this type of additional payment to be taken into account? I was going to say in my reply that i was willing to accept £xxxx as a setttlement figure because in my calculations if i paid even a minimum PPI monthly payment over the 10 year period this would be the amount i was due in return.
Any Advise or any similar cases?

They do I assume go back as far as they can go as long as they still hold the details of the account going back as far as possible.

I can't find my original post asking for help, but I thought I would give you a quick update.
You may (or may not as this thread is so long!!) that a relative had been off sick and whilst so, had taken out a Tesco Personal Loan. He was told to take out the PPI as he had not received a offical diagnosis to his ailments - this was by an advisor at Tesco.
We did not have the advisors name ( it was 6 years ago), but thought we would try anyway. We filled out the questionnaire and sent it to Tesco about 2 weeks ago, by recorded delivery.
We had a letter today from them , saying that they have reviewed the records at the time of taking the policy out as well as considering the comments we made on the questionaire. They have said that they are unable to confirm precisely what info was given at the time the policy was taken out....
but as a 'gesture of goodwill they are prepared to refund in full all the PPI Payments made to date which is nearly £3000!!!!! IN all in all, this means that a loan which was not due to finish until late summer 2011, will now be paid off by August this year!!:T:T:T:T:T
We were ecstatic when we opened the correspondence this morning - we never dreamed we would get a) an answer so quick and b) the repayment of all the PPI installments. We didnt think it would be settled on the basis of that one letter/questionaire we sent - so thank you so so much Martin for getting all this PPI malarky out into the open air, and thank you to everyone who offered advice!!

Good to "speak " again:)
The account is still active though i cancelld the PPI back a while ago but never reclaimed to now:(.
They state " unfortunatey we are unable to obtain a copy of your application form and statements prior to 1993"
They reckon that the PPI they are offering to repay goes back to 1993 - i have statements covering 2000 - 2007 which show the ammount they are offering so i know they are not going beyong 2000 with their offer.
Unfortunately i dont have any statements for the period 1990 - 2000 but this was where i was wondering was it worth "appealling to their better nature" and asking for them to take that period into consideration with out having the proof of PPI being paid? They know the acount was in existance from 1990 and surely they would realise the PPI was as well.
I was going to give them a short peiod to reconsider their offer before i go to the FOS:D
PS If you go to the FOS when you have already received an offer/settlement figure can you run the risk of loosing that amount of money or is it the minimum you are gauranteed to get paid?
