PPI Reclaiming Discussion part 4

Good to "speak " again:)
The account is still active though i cancelld the PPI back a while ago but never reclaimed to now:(.
They state " unfortunatey we are unable to obtain a copy of your application form and statements prior to 1993"
They reckon that the PPI they are offering to repay goes back to 1993 - i have statements covering 2000 - 2007 which show the ammount they are offering so i know they are not going beyong 2000 with their offer.
Unfortunately i dont have any statements for the period 1990 - 2000 but this was where i was wondering was it worth "appealling to their better nature" and asking for them to take that period into consideration with out having the proof of PPI being paid? They know the acount was in existance from 1990 and surely they would realise the PPI was as well.
I was going to give them a short peiod to reconsider their offer before i go to the FOS:D
PS If you go to the FOS when you have already received an offer/settlement figure can you run the risk of loosing that amount of money or is it the minimum you are gauranteed to get paid?

You could just contact them and ask is there anyway at all they can just make sure they don't have anything still held prior to that year they have started from.
The chances are if you go to the FOS it will be the same result, but you could be waiting ages before its been seen to........:eek:
You could wait and see what others have to say on this as well if you want to.;)

My bank did a similar thing when I reclaimed on some loans for PPI. They redressed 3 ofthe 4 because although I did have the credit agreement they did not have a copy of the settlement figure from the 1990's. I did not win with it even with FOS. They said that if I had a copy of what i settled the loan at they would consider it. I didn't so had to say goodbye to that amount.0 -

front loaded policys are not worth the paper they are written on, they are rip off
go back and tell them you were mis sold and if they dont redress as such you will go to fos, you will only be better off with a full redress, a "goodwill gesture" will cost you thousands in the long term
and is a polite way of saying we ripped you off once, AND WE ARE DOING IT AGAIN YOU SUCKER:mad::mad:
Does anyone have experience claiming back PPI after 5 years - I am concerned about the 30 day window. When the time comes is it best to claim via letter sent recorded delivery or do we need to call and request a form of some sort???0 -
I have asked for all data from Egg regarding my Credit Card that I have had a balance of approx £7,000 on for seven years since opening the account, with a view to reclaiming.
I completed a £7,000 loan with Egg in April 2010 that was set up in Jan 2004 I have just claimed mis-selling on this and they are looking into it.
As this is my first time reclaiming, what can I expect (if successful) on both claims? I think payment on the card for PPI was £40 per month but they themsleves stopped the PPI last year without authority.

I have had dealings with EGG and i think you will be pleasantly surprised how quick they will deal with your complaint!
from start to receiving my cheque i think it took about 5 weeks.:)
As for the credit card i think they will probably take the refund of the balance of your loan.
Would be interested to know if they agree to pay you the 8% Interest - not too many of us on here have been paid it.

Hope your lucky with this, good luck.
You should expect to receive ALL you have paid in PPI, interest, and hopefully 8% interest of what a court would award on top for being deprived of your money.
If they calculate inline with the Financial ombudsman service (FOS), then you will receive the interest as shown on the link below, on how the FOS calculates PPI refunds:

Thanks for this, will definately be writing back to ask them to redress the complaint. If no luck we will forward it to the FOS. My only worry was if we refused this offer and complaint did not uphold we would not be able to reclaim the 21K PPI after 5 years and would lose out all together. Now that you have all kindly reassured me I am all set to move on with the complaint.

As regards the reclaiming the 5 year cashback deal then you have to follow the instructions of claiming it that would be on your terms and conditions of the PPI (that is IF you have them). If you do not then you can write to FP and ask them to send you a copy of them. I would always send everything recorded delivery to do with this firm too and definately send off for your cashback by recorded delivery too IF you have to reclaim and have not won. I think you will win though TBH.0 -

Terms state "upon 5th anniversary of PPP commencing you will need to send a written claim to FP....address.......within 30 days of natural expiry of PPP". PPP start date is 31/03/06 so I will send letter beginning of Feb2011 recorded delivery. To be honest I didn't realise I had been mis-sold PPI until earlier this year as I was googling PPI to see if anyone had reported being shafted over claiming the 5 year cashback. I found this forum which was a real eye opener and realised we could go for mis-sold. I'm so glad I looked into this and am really grateful to you all.
