hi agin all, i have a ppi claim with the fos at the minute and its with the one and only firstplus. my question is i have had to pursue the insurer as my broker was not overed by gisc and i was wondering if i didnt win this ppi claim could i go for unfair rebate>? and if i did who would i pursue with? firstplus? or would it be again the insurer?

I think Marshallka will be able to explain on this one for you, but if you were not given a fair rebate when settled, your in your right to take it this direction, however, I do also think the FOS are looking at ways to hold the insurer/underwriter responsible as well, as these are the ones who accept or rejects applications etc.The one and only "Dizzy Di"0 -

Hi there all.
Just wanted to tell you I have won my claim against Barclays!
I can't believe how quick this has all been.
I submitted my first letter in March, had a letter back confirming they had received the compaint and stated when they would reply.
They did so with a form for me to fill in, I asked for more advise here, sent back with a request for the two ealier top up loans to be looked into.
Another letter of comformation, then a telephone call just asking me if I had put the claim through with one of the companies that people sometimes go through.
I said no was done by me only.
Then she said my claim had been upheld and asked me if I would like to know how much would be refunded to me.
I said yes please.
I have been refunded £3470.26.
Put directly into my account. :j:j
I then received the standard letter I think explaining all, and stating that they had reasonable doubt in this case to uphold my complaint.
Then this morning two letter with forms for the two other top up loans that they have already taken into account (I think) I will look at the letter more carefully now in case not so.
So a huge thank you to you all, as I would never have been able to do this without this site and Martin Lewis's help with the letter templates etc.
Made me go from being on the edge of overdraft all the time, to a little safe money now.

Right now I have settled down I have read the letter properly and they have upheld the original claim I put in for the last loan I had, 2004.
I had put on the form they sent me that I would like the two previous loans looked into as all of them were top ups after the original loan I took out in 1998, the second top up was 2000.
I have two forms to fill in on those two now.
So do you think now they have upheld the complaint on the last top up loan, that I have a chance of the two previous loans being upheld too?
And should I give the reasons as the same as the last one, as they were all follow on loans before they had ended?

I am in shock, and have never had this much money in my Bank account.
Huge thanks again for your help and advice here, and anyone else thinking about doing this, go for it!

hi,
in which case you want them to re-look at their offer, you want the ppi element removing from the loan and the loan repayments reduced for the remaining term to £798 per month. which would be for th eloan only.
you want them to refund you premiums and interest you have already paid which equates to £9750 in premiums already paid, and £1,657 in 8% simple interest for being miss-sold. so in total £11,407.
i know its less than they have offered, but if you take their current offer and leave the payments in place you will be worse off in the long run.
for example, if you take the offer of £15k you will still have to pay an additional 251 payments of £195 = £48,945 for the remainder of the loan term, this is on top of the £9750 you have already paid.
so in effect they will give you 15k but it has/will cost you £58k
ultimately its your decision, i know what i would do.
if it were me i would go for the loan to be put into the position it would be as if the ppi had not been added and a refund of premiums paid, which is in line with the FOS.
to get this you may need to go to the FOS.I'm proud to say that the banks no longer take money from me after becoming debt free0 -

Thanks, this is pretty much what we thought. Do you know if we take this to the FOS and if claim is not upheld if we can still claim back the 21K after 5 years of not claiming PPI as insurance is not being cancelled.
And if FOS are still inventigating at point of which we need to claim the 21K, can we still do this with an ongoing investigation with FOS??

to be completely honest i don't know, however the FOS are taking about 6 months so it may not make any difference,
i'm sure others have had experience with FP and will advise accordingly.
