    I always intended to go with template letter 2 if I had a rejection letter, but now you have both said that this reply is a "go away" letter and that my case is infact viable enough for a refund of MY money, I can do it with more confidence.
    I've got the letter ready to post and I will fill in the FOS forms ready to be sent off if they even try to put me off again, let alone contemplate another rejection.

    I was hoping for a little advice,

    I made a claim against PPI sold to me when taking out 2 loans with HSBC on the grounds that I was not informed by the salesperson on either occassion that the PPI was infact optional.

    They held me off with letters saying 4 weeks needed to investigate my claim, then another 4 weeks, then another 4 weeks. They went over the deadline that THEY gave me prompting me to phone them.

    Today I recieved a letter from them informing me that they were not upholding my complaint on the grounds that within the information pack they gave me when taking out each of the loans was the explaination that I could cancel the PPI within 30 days of taking out the policy, they also enclosed the paperwork that i signed at the time.

    I know that I can send off the second template letter for them to look into my complaint again, and I can go to the FOS, but on the grounds of my complaint, do I have a strong enough case to warrant the refund I require?

    What you received is totally standard, its a fob off in hope that you don't go back to them.

    The point is they have mis sold you the policy, despite them stating you could have cancelled by 30 days and so on.

    Many used to think the PPI was all part of the loan anyway, so if cancelled the whole lot would have to be repaid, if they did not explain this to you then you do in my opinion have a case.

    Personally, I would give it another go, tell them despite their rejection you do not feel your complaint have been investigated properly, and request they re-look into it and state just because they have stated you could have cancelled by the 30 days, you still have genuine reasons to reclaim for being mis sold, and tell them if you do decide to go to the FOS, they will incur in further charges if the FOS upheld in your favour.

    Give them something like 7-14 days to get back to you, then if you hear nothing, write to inform them your complaining to the FOS with all the evidence you have to support your complaint.

    I have held an A&L credit card for over 8 years and have had PPI on the card for almost as long. In 2009 I lost my job and made a claim with St Andrew's (PPI) They have been paying out for a year and due to complete their 12 months payment this month.
    I had terrible trouble trying to sort my claim out with St Andrew's and as a result missed a few payments on my credit card. I have a few questions that i am a bit confused about and hope that someone on here will be able to help.
    Here goes:

    I would like to cancel and reclaim my monthly payments made to St Andrew's . Can I do this even though I have claimed?

    Will I be able to claim for the full length of the policy even though i have claimed?

    I was unaware that the policy ended after year, could this be a reason for being missold amongst other reasons?

    Will missing a few monthly payments alter the decision regarding a reclaim?

    I would really appreciate any advise anyone can give me

    Just an update, I managed to get my forms sent off on monday, to the local Cooperative branch where I made the claim and today I got a phone call from the local branch. They told me that they do not deal with this at the local branch and they are going to forward it to head office, so I am glad they have acknowledged receipt and hopefully things will start moving forward now.

    some people have claimed after the policy has paid out, if you do this and are succesful they will deduct anything htye have padi you from the premiums you have paid if you are succesful.

    yes, you can re-claim all the premiums you have paid since the policy started

    this could be a reason for a mis-sale, however check this out on your T & C as some finish after 12 months but then pay off your credit card balance in full as final settlement.

    congrats on your win, you only get ppi back you have paid to date, as your loan is still running you would still have 20 months of the ppi left to pay, so you dont get anything back for that, it seems to me you have got back ppi paid to date with interest in the offer, what a good result !

    hi there in response to fos timescales i put my northern rock complaint with the in feb 2010 and it will be settled on monday spoke to adjudicator today and worst way im getting back £8326 unless they calculate more so 4 months to see to it not to bad
