    Great thanks and you, nice chilled weekend visiting the tip and emptying the garage between trying to translate this SAR :D

    Another thing I notice is a totally unenforceable credit agreement. Not signed by Mbna, not even a box for a signature.

    Have got record of every ppi transaction on the account back to 2003.

    Will get onto the ICO see what they have to say.

    Fact is in my eyes if they dont have the call and there was no agreement so you can bet your bottom dollar(or quid) they'd of pulled this out had I tried claiming. :)

    I have not got a clue how these unenforceable agreements work myself, but hope something is resolved for you very soon.

    Well in this case its irrelevant as there is no balance but in simple it means that the agreement would not be sufficient for a creditor to take legal action with. If they cant get there paperwork in order they get penalised by losing the right to claim a debt in court.

    So - the short version of my saga is this:
    Sept 2004 took out loan with Paragon Finance through Hfs (now Capital One) for £12k + PPI of £2500 (which was added onto the original loan). I think it was mis sold for a number of reasons. Did all the letters and, to cut a long story short, eventually Financial Ombudsman couldn't help due to company not being regualted by FSA at the time. So went to a company who said they could help - but 18 months later they have given up as they said they could not get the information they needed to proceed from Paragon.
    I then downloaded Martin's SAR letter and sent off my cheque and now have copies of all the documents I signed etc but don't know what I can do now. Does anyone know if I should try the no-win-no-fee solicitor avenue or is there a better way??

    Please help.

    Hope your well

    Before you think about going to any claims management companies, you may have read some horror stories on these.

    You can actually pursue this now through the actual insurer.
    If you do not have the policy details of the insurance only, then the lender should supply them to you on request.

    The FOS are suggesting people for being in the same situation as you to go the insurer/underwriter direction, they are trying to hold these responsible as well, because they do have part liability alongside with the broker, they should have ensured you were eligible for the policy.

    The FOS can also investigate against the insurer as these would have been regulated, so what I would do is contact the FOS anyway and explain your situation and mention about the insurer if they don't suggest this to you first.

    I actually have one of mine in with the FOS because before that all my previous cases were sent back to me by the FOS - due to the same reasons as yourself, and the insurer is another avenue to take if all else fails.

    Give the FOS a call on this when you can, good luck and please let us know how you get on, cheers.;)

    Does anyone know the address to write to Egg.

    My son had a credit card and loan with them and both had PPI. We cleared them for him about 5 years ago when he got into a financial mess and at the time we thought he had been ill advised.
  • Has anyone had any success in reclaiming mis-sold ppi for Nemo personal finance. I recently discovered that they had added £4500 to my personal loan without my knowledge or consent, i am currently trying to resolve this issue - they are saying that they didn't sell me the insurance (norwich union did) - well i would like to know how they managed that one when i got the loan from them.
    I wish i had never got myself involved with this company:mad:

  • Just a quick update, I sent everything off to the FOS and eventually got a letter back saying that they were writing to LTSB and would pass everything along to an Adjudicator but this could take a few months as they have a lot of backlog to deal with. That was about 6-8 weeks ago, do you think I should chase them up to see if they got any where with the bank?

    Hi there and welcome.

    Mine in regards of Nemo was finally resolved through the FOS, they are not the easiest of them to deal with, but if it was Nemo that arranged and set up your loan then your correct in writing to these, so keep at them, if they don't resolve by the final decision then go to the FOS.

    However, you could actually contact the FOS now and tell them your problem of them trying to fob you off on to Norwich union where it was Nemo who set this up for you, and ask them to write to them on your behalf, unless its the final decision.
    If this was final then go to the FOS to complain anyway.

    Try this, used it for charges reclaiming, they will forward it to the relevant dept.
