    When you write to them, you give the reasons of why you believe the policy was mis sold, so basically you write that you have evidence of Payment Protection Insurance (PPI) was added to the Credit Card, where you note this is still been paid within the monthly repayments, and you (your partner) chosen not to take this option (enclose a copy and not the original agreement) for their records of evidence of your proof.

    The link I posted on my earlier post of the guidelines of reclaiming is helpful as well.
    So use as a guide, and if any other reasons apply then add them as well, there is a checklist on the guideline link.;)

    Your partner have been deprived of her money in this case, and they should compensate with that 8% int of what a court would award due to this reason.

    Capital One actually provided the evidence in response to our SAR:) so they already have the original agreement. I was planning on just writing a letter pointing this out and the FOS's approach to redress if they disagree or refuse the claim.

    Yes definately, the reason why I suggested enclosing a "copy" was in case they try stalling by stating they require you to send them a copy, some have done this even though they have provided them with this in the first place........also just in case they try using stalling tactics.
    The agreement possibly came from their data debt and not the complaints part.

    But yes defo mention the FOS as well.:)

    A quick question and apologies in advance if it's already on here, but I'm a bit daunted at the 529 pages!! :rotfl:

    Having recently checked my credit report, I've had a card from Lloyds TSB Bank that was settled in 2007. I do vaguely remember this and thought I'd chance my arm on the re-claiming thing. However, I can't get any more details on it. Who would I write to and would they give me details without an account number?

    I've no paperwork as I've just gone through everything and it's not there.

    Hi there, hope your well.

    If you no account number then this should be shown on the actual credit card, and/or monthly statements, for more information then you write to the data dept, and request for a Subject access request (SAR), they have 40 days to comply, and you also enclose £10 postal order or cheque payment, I would post by recorded delivery as well.

    If you cannot come across the account number then give them as many details as possible, full name, details of dates when taken out, your date of birth, address and so on, this should help them track down your info.;)

    Just one more question, do I just send a letter asking them to cancel and refund? I have had a look around but can't seem to find what I'm looking for, do I send the form thing from the main part of this site or are there some template letters knocking around? Not to hot at the old letter writing so have been looking for templates but can't seem to find them.
