Well a further update on my Sainsbury's (Bank of Scotland Claim). Over the weekend I received a letter from them stating that having investigated my claim / concerns and as a valued customer they are willing to put me back in the position as though I had never had PPI on the loan as a good will gesture (they won't admit liability, aww shucks!). They are going to write to confirm the amount soon and advised that I will receive a cheque within 4 weeks. Just to have in mind when I receive the next letter, what would you expect the amount to be?
Cost of PPI alone? plus interest? (is this over the period I had the loan or another method?)
Just want to have in mind others experiences / thoughts, thanks~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

Well basically they must defo refund all you have paid in PPI and assume interest as well.
If they were to put you back in the position as if you did not take out ppi, it should therefore to what I know of be calculated in a similar way to how the FOS would calculate.

they wrote back stating as I tried reclaiming unsucccessfully 13 months ago they wouldnt look into the case again (i gave up after their initial response last time)
theyve also said the FOS wont be interested as i have left it more than 6 months since original reclaim attempt.
is there any truth in HSBC's claim that the FOS 'probably' wouldnt look into the case?0 -

Hi there
On the final letter you receive from the bank should enclose details of the FOS, where you have 6 months as from the date of the final letter.
Can you remember if they issued you with a final repsonse at all?
The FOS can consider taking on cases in mainly exceptional circumstances if for instance you could not continue to take your case to them in that timescale, maybe medical/hospital reasons then for example.
If you did not receive the final response, then let the bank know this.

thanks for replying di...
original response (13 months ago) basically said we werent mis-sold the loan etc...
it said if i had any evidence i could forward it to them...
then after we got that letter we rang hsbc to just cancel the PPI (again told i couldnt, and would have to apply for a new loan and would therefore lose the cashback incentive that was on at the time for allowing the loan to run the full term)
so left it....... stupidly!
their most recent letter in response to me sending a claim letter in again 2 weeks ago states:
Our records show you made a similar complaint about the above plan in feb 20. your concerns were subsequently investigated and a letter confirming our findings was issued to you on 17th april 2008. i attach copies of this letter and would confirm that letter represents hsbcs final response on the matter. didnt say final response only that i could provide further evidence or contact the FOS.
then it goes on to say the letter said if i wasnt happy after the final response i should have contacted the FOS and submitted my complaint within 6 months.
sooo.... do you suggest I tell hsbc they never said this was their final response in the original letter? or write to the FOS explaining this...
original letter 3 pages long with no mention of it being a final response.
this letter 2 paragraphs long with 4 mentions of final response and the closing line "I confirm we are taking no further action on this matter".0 -
hi di, not sure on this, but i think i read somewhere that fos have told banks to go back to no wins and relook at them? dont know if thats right xx0
