Hi I am trying to claim my ppi from my Marks and Spencer credit card I closed my account in 2007. I have sent a request for ppi refund and they contacted me to say that as the account had been closed for so long they are unable to see if ppi was applied/ and or / missold. I found a few statements and sent for a SAR request, this shows PPI on my account.
I have now sent a second letter asking for them to re investigate my claim, but am asking the lovely people on this site for help? Anybody out there experienced anything like this or can advise me on the next step?0 -

I've never had dealings with these but sure many have done and will hopefully post up of their experiences with these.
Good one for finding the statements, did you also enclose Copies (not originals) with your letter?
If they try fobbing you off with another excuse (they should not do now with the details you have provided to them) then move on to the FOS, but they should actually still have some details on your account, because it was only 3 years ago you cancelled, where they should hold for at least 5/6 years.
Also if you get any further problems in regards of asking for any documentation, you could contact the Information Commissioners Office (ICO)

who should be able to help.
I would personally contact them anyway and tell tjhem what you have been told in regards of you closed/cancelled the account in 2007 and ask if they should still be holding any of your details on your accounts for the last 5/6 years.

hi all
has anybody claimed their PPI back on a Capital One credit card at all,just had my list of charges from them and have just noticed there is PPI on.Also in the letter they sent back there is a cc agreement with my signature on and the date 01/03/2001,when i took out the card but nothing else.would i have to request copy of agreement to see if it has been added.

Hi Colin.
So the agreement you have is just with a signature but nothing with the ppi details?
As long as you have the accoount number you can of course continue to make a reclaim for the reasons you have for being mis sold.
Sometimes they send you a copy of the agreement back with a letter, but not always.
As this was on 2001 you taken this out, the chances are very slim of them having a copy, but there is no harm in requesting for this and enclosing a £1 postal order or cheque payment and ask that they send by 12 days, if they cannot do this then they should write back to explain and of course return your payment.
But you have the account number and statements to prove PPI was being paid.
So with your reasons give it a go and see if they send you the agreement back with their response.
They have 8 weeks in full to respond, post by recorded delivery for your proof of posting.

thank you for your response.idont know if i have a shortened version of the agreement.the only information on it is...my name and address,a small paragraph about the cc agreement,my signature and the date thats it.
i have sent in a claim(by recorded delivery of course)today to claim back the cc charges

It does not seem like a full agreement does it?
But not to worry, by having the account number will be a good help to help with your reclaiming, as they can still track your account down this way.

My latest update, not a lot different to the last letter really but still it seems to be going somewhere. I notice on each letter, even though the main ref number stays the say but the letters and the last 4 differ to other letters, so I suppose
its due to the face its moved on from section to section to see if the case can be looked at or not.
Letter received through the post of an hardcopy update dated 04 March 2010, the one above was by email dated 03 March.

At this stage I confirm that we have everything we need from you and your complaint is now waiting to be passed to on of our adjudicators.
