Just running through the defence document and para 11 states:

furthermore the defendant does not accept that the claimant has suffered any financial loss in this case. the claimant is put to strict proof of any loss.

what sort of proof do they require? a screen grab of the product for the next cheapest price??

It appears that i have the same paperwork as yourself, only with a few small details changed.

    Whoooooo..
We may not win this, but im still an integrated dishwasher short of a fully fitted kitchen..

If you don't win I'll show my a55 in B&Q's window............if they have a window big enough. :D

  • As i said in the other thread, some poor person will have to commute the distance up here, which could be a nice 540mile round trip.

Only decent thing around here is that the hotels are cheap, you can have a walk along the sea-front / pier & get some £2 fish and chips..
  • professionally, the charge out rate has got to be £150/£200ph.

    You do the math.

If they were going to defend this in court I'm sure they would just get a local B&Q manager to go through the motions/script. Too costly otherwise.

  • they couldnt drag someone not versed in law to court can they - lol

A little formula how things work in head office..

    1) If A-B = -ve, then settle OOC
    2) If A-B = +ve, then go to court

    A is Claim Amount
B is Staff Costs, travel, accomodation etc

    [/joke]

Though, there are only really 3 options here..

    1) They settle out of court
    2) They goto court, pay staff fee's, travel etc & win. Only lose staff fee's.
    3) They goto court, pay staff fee's, travel etc & lose. They lose staff fee's & lose the court case
    4) Claimant cancel the case (Option unavailable at the time)

1 being the best, 3 being the worst.

    3) would also give a CCJ against them, not badges they would want to cherish.

how does that work exactly for big companies. I am sure the likes of B&Q have lots of CCjs from court cases not defended etc but it doesnt put them on a blacklist.

    interesting question tho!

Perhaps B&Q will have a look in their magic warehouse (you know, the one that suddenly pruduced dozens of water butts last week) and discover they have your dishwasher after all. :D

The real winners in all of this, as ever, are the solicitors. I'm sure B&Q are paying them handsomely for producing their joke of a defense.
