I didn't get a £1 Hoxton room and I'm not getting a Zanussi dishwasher for £94 but in the past I've had two free return train tickets to London, a free family holiday to Haven (brill) and bargains too numerous to mention. I love this site and am thankful to all who post.
You win some, you lose some.
:T :T :T Well said!
Out of interest is anyone getting a dishwasher?Give a person a fish and you feed them for a day; teach that person touse the Internet and they won't bother you for weeks.:D0 -

Loss of bargain - i.e. the difference between the contract price (£89) and the market price (£349).Sale of Goods Act 1979 c. 54
Part VI ACTIONS FOR BREACH OF THE CONTRACT
Buyer's remedies
51.— Damages for non-delivery.
(1) Where the seller wrongfully neglects or refuses to deliver the goods to the buyer, the buyer may maintain an action against the seller for damages for non-delivery.
(2) The measure of damages is the estimated loss directly and naturally resulting, in the ordinary course of events, from the seller's breach of contract.
(3) Where there is an available market for the goods in question the measure of damages is prima facie to be ascertained by the difference between the contract price and the market or current price of the goods at the time or times when they ought to have been delivered or (if no time was fixed) at the time of the refusal to deliver.0 -

Yes.
I've already explained why in my earlier posts in this thread. Could you be more specific as to why you disagree?
Because of the terms on their website.
But you think otherwise and you also think a court will agree with you, but why would you want to and why should you gain from someones mistake.
If everyone who ordered a dishwasher was offered compensation at £260 cash or a dishwasher, that may well help to put another struggling retailer out of business or at least cause one person to loose their job. Is that what you want?0 -
He won't get anywhere as B&Q clearly has an exemption clause in their T&Cs, which everyone agreed to when ordering the product.0

I think we've already put that argument to bed, back on page 13.0

The item is not OOS i'm not impressed that the same make and model is instore and selling for £369. Yes the barcodes are different but B&Q have stated
This model of dishwasher has now been discontinued and consequently B&Q will not be stocking it in the future.
But my local B&Q have 4 in stock today at £369 though0 -
