If I was a landlord and used them and they didnt pay my rent I would avoid them and go to tenant directly. Obviously you cant ask the tenant for monies that they already paid rent for in good faith0

tbs624 - this thread is confusing as some people posting are tenants with Rentapad who can't get their deposits back or tenants whose landlords have told them Rentapad aren't passing across the rent they are paying. Others are landlords who aren't receiving their rent from Rentapad.The bottom line seems to be that Rentapad are suffering financial difficulties are are robbing Peter and Paul to pay themselves whilst continuing to trade! I've no doubt it's like a pyramid scheme and anybody who is unfortunate enough to take out a tenancy with them now will find their deposit being used to prop up the business further.
Until they are stopped from trading then this will just continue. Taking rent from tenants and not passing it across under the terms of a contract is fraud. Telling a tenant that their deposit is protected but then keeping the money is also fraud.
While ever the law allows anyone to set themselves up as a letting agent with no regulation, no qualifications, no expertise etc then LLs have to take the time and effort to check that their LA is actually doing what they are supposed to be doing. The LLs can provide all the evidence necessary for fraud matters to be pursued where appropriate.0 -
I've contacted trading standards, who basically have said they'll forward the complaint on but also that as I've already started court proceedings it's mainly down to them (the court) :S
Kinda shocked really, perhaps someone else could try complaining to trading standards as well, which might speed up the matter? If they have complaints from tennants and landlords it might speed things up.
I'm still going to speak to the police, even if they just visit or something, I don't know, I can't believe how easily this is allowed to carry on. He's openly admitted to a court that he's taken the money for a deposit and no longer has it. Madness.0 -
There was something on watchdog 2 weeks back about another company who were doing this, even putting tenants in, changing locks without landlords permission and not giving rent. They went under and manager opened another shop a few doors down had same client list etc and denied its old company in new name, but then went under again0

i would suggest contacting Manchester Evening News. Perhaps enough people now aware and in contact with each other to make a joint visit for a photo as well?

Seb - just confirm - with your action against rentapad, have you actually had a court hearing or a judgement awarded in your favour?0

tbs624 - No, we started initial proceedings to which rentapad replied offering £50 a week. We've refused this and are waiting further information, I'm assuming it will go to the court next and I'm guessing they'll decide what action needs to be taken.
I'm not really sure what details I'm safe to give out here, but I wasn't satisfied with the response we recieved or that rentapad are in such a bad position that they are unable to repay the debt more quickly.0 -
I just chased up our claim, Rentapad were ordered to pay us £920 two weeks back, no sign of it though
I'm just looking into what my next course of action will be.0 -
Now that I have a CCJ, it's been almost a month and we have no money.
I'm going to go down the warrant of execution route although, am I supposed to allow a certain amount of time between the date of issue of the CCJ (it was issued on the 1st of May) and the warrant of execution? As it stands I'll probably post the forms off this weekend. I've had a look through the hmcourts site without being able to find much about how long I should wait.
A lot of things don't add up with this case, I know this agent is taking a lot money from a number of sources. Where is this money going??
I'm not holding out much hope that we will see a penny of our money again0
