I have long maintained that people posting negative experiences about these medicals really does do more harm than good.

It really is a fallacy that there is a bonus for everyone who is refused benefit.

Just get all your medical evidence together, take someone with you, tell it like it is honestly and I am sure that you will get what you deserve.

Equally coming into the thread and posting inaccurate information isn't always helpful. The ATOS staff do not make the assessment on who passes or fails, that is the job of a DWP decision maker. They will merely construct a report from a 15-30 minute interview with a customer.

The issues that many people are facing (not rumour simply because you can see examples in this thread) are that the honest ones are the ones who generally will suffer because they don't know the system and how to "play" it. These medicals are being conducted dishonestly as the opposite is being recorded of what people respond. Now granted I know the posters in this thread from Adam but I have come across plenty of people with identical scenarios and experienced it first hand with my father's attendance allowance claim where upon attending the tribunal with him and an advocacy worker, the panel were horrified that the case had ever been put before them and promptly back dated the claim 18 months. Once again the doctor had ticked the exact opposite of the responses my father gave. I know, I saw the evidence whilst we were preparing the case for tribunal. You can't base a FAIR system on one that is at best flawed and at worst dishonest to the point of being criminal.

For the record I feel this is absolutely the right forum to be discussing this issue.

That is true, about the bonus..actually the doctors or ATOS i am not sure which gets fined for every case that goes to appeal!

  • It is important to note that these tests are subjective - not objective - they hope you are having a good day to disqualify you from entitlements.

I wrote the following some years back - just after being disqualified for not getting better:

First a warning for those on Incapacity Benefit. When you fall ill, you expect the State to help until you can get back to work. I was not claiming all entitlements, just enough to get by - until I recovered from these ops. My Doctor and the Company Doctor advised me to do part-time therapeutic work. If you do any other work while ill you may be considered a fraud.

I have written proof that the Benefit Agency deny your right to legal entitlement - if you try to go back to work and fail to get better. Below is a scan of prejudiced evidence they used against me.
    injurious.jpg

I did not get better - this was used against me, to stop my families legal entitlement to benefit. I was later to find out the rules allow them to use opinion against you (in legal action). This is against the old and sick - something that the police can not do with known rapists or child molesters. Yet they ignore the rules that help you - like the one that says they have to reply to any questions. Indeed, when I questioned their decision, they effectively tried to fine me £858 for doing so. You would not believe all what I found. The Benefit Agency even have rules to make you rob money from your children before allowing you benefit.

Perhaps worse of all, they have rigged the 'all work test' - used to disqualify sick and disabled people from benefit. Proof is with Social Security Commissioners File:CIB 5361/97. Mr PL Howell QC, on 20 May 98, said 'There are obviously some disturbing implications...' This abuse has been closed - but it does not close the reason behind it. By scrutinizing the figures and looking at trends, you can work out their true intent. My findings, analyzing Hansard figures, were a lot more disturbing than that discovered by Mr PL Howell QC. But enough of that - for now.

You obviously must suffer from the same problem then as you dont seem to have taken any notice of what I have said previously. Im not looking to get help "managing" medicals, Im not even going to bother explaining again. If this thread is in the wrong place then please have a moderator move it. But that is it for me, Im not going to bother coming back to this thread because all its doing is upset me when Im having a bad enough time as it is. You do not know my situation or anything I have been through yet you are throwing out your comments on something you know nothing about.
Well, I thank those of you who have took the time to help, I really appreciate it and good luck to those who need it. If you wanted to upset people then well done, you got your wish, I just hope the next person who wants help isnt so unlucky to get the same bunch of nasty people and their nasty and uncalled for comments.
I got the answers I was looking for, I am getting the help I need from a legal team, so thankyou all for your time.

It's strange. I've read this whole thing from start to finish. Had lots of opinions before and during the read. Bye the time I got to the end I realised, I can't pass comment at all. It's a forum, that saddens me.

    For lots of reasons.

Not all of them to do with the DWP. Good luck to those that this forum helps.

But I dont think its even helpful,.

its all negative, and negative, nagative. God I feel so flat now. Onwards and upwards to you all! Hope better health and a good job comes your way. Take care.

Just a little something that might make you smile...!!

My neighbour has been on IB for many years and recently had to have a medical from the ATOS people. She asked to have the medical at home as she is virtually housebound with arthritis, and this was agreed.

She has two hulking great Rottweilers that as really soft, but look anything but.

The doctor was Asian, and I've heard that not many Asian people like dogs much. The dogs are female, and could lick for England. So when the doctor saw the dogs, he asked if they were "ok" and she said they were fine.

The bigger one ambled over to the doctor, had a good sniff of his nether regions then started licking him. Not to be outdone, the other dog came over, dispensed with the sniff and just went for the licking.

The doctor was shaking and cowering, and asked my neighbour to put the dogs outside as he doesn't like dogs. She said she couldn't as the dogs would need to be manhandled outside (not strictly true...!) and she'd need to wait for her husband to get home as she wasn't physically able.

The poor doctor raced through some questions in 5 minutes flat then legged it out of the house.

She heard today that she had passed the medical test. She knew she would anyway, but her dogs at least got the medical cut short!!
