what should my next course of action be and has anyone worked out exactly what my surplus is i keep getting different figures and have seen quite a few on here now too
Contact CAP as in my previous post - they will sort out what you owe and to whom and negotiate an affordable amount to pay back and if necessary guide you through bankruptcy. They will firstly make sure you have enough to live on and to pay rent etc then and only then will they consider the amount payable to your debts.
A CAP person comes to see you at home and goes through everything with you so that you have that pressure taken away from you. You need this support HA, give them a ring.Christians Against Poverty - www.capuk.org0 -

can someone please check my last SOA and see if it can be tweaked in any way and come up with exactly what my surplus figure is. plus has anyone got the SOA that the br people work off please?0

The last one I did for you was £918 and that was pretty accurate I think.
MoT idea is brilliant. Get in contact with CAP. They will be able to offer you so much support and you don't have to have them to your house. Please get in touch with them.

thanks, i am in hospital most of today as now along with a failed spinal fusion they think i may have cervical cancer. i had 3 smears all showing pre cancerous cells and had an operation to remove them a year ago, wont go into details as its not exactly breakfast conversation but gist of it is they want me in today. depending on what time i get hom i will ring CAP. to be honest though i am dreading calling them to go through the same hour and a half conversation again. whatever the outcome of that call is i am going to stay with a friend for a week so will not be able to do much more on it all until i get back. obviously i will still come on here and fill you in with any new information. thank you again for all your support. i still cant get it out of my head that if i do manage to get someone to help with in applying for br that who ever the powers that be at court who get to look over my figures will say i have too much surplus cash and i would have wasted the £495 br money0 -
First off good luck for today. My daughter has the same problem so no extra info needed on my account.
Now how many times do we have to tell you:D . The judge will not refuse you bc if you have a surplus income. If your debt repayments outweigh your income you are insolvent. Insolvency = bc.
Now go get yourself sorted,stay at your friends and come back with some positive thoughts. Take care girl. hi homealone i had the same sort of operation(loop cone biopsy) as i had the same problem. which reminds me must book another smear thanks
and as dalip said you will only get refused if you dont understand what br is or you have a million pound in your savings account so stop worrying.
ive already said the amount of allowences you get on br is different to an IVA/DMP they are only trying to get you to do one of them as they get paid for doing it. so stick with us honey we will help you through it
ok im going to list a step by step guild to what to do
right youve already took loads of advice from the charities but still give the CAP a ring if they again say DMP and you still want to go br then go br you do not need their permission
ring your local court to find out what service they do whever its drop in or appointment

as i think some benefits you recieve will mean you only pay £345 for the OR
we will help you with your SOA but as dee dee said shes ajusted it to the most acurate possible
seen as you do have an income other than benfits at the moment(you said you dont know for how long) this will mostly go towards an IPA which is an income payment agreement which will take a percentage of this money to pay your creditors for 36mths. but as soon as this stops contact the OR and your payments will be ajusted.
as you have inquired about already your benefits will not be included as they are for you so will just be your extra income
right at this point you should have filled in your forms and printed, have your court date approaching, and have your fees saved.
the day of court you will arrive be took into a interview room where they will just go through your forms and check youve filled in correctly, then pay the £345 and swear an oath. then most people go back to the waitingroom and either see the judge or then be given your br papers and told about the OR interview in a few days then be allowed home or go to talk to the OR straight away for your interview either by phone or face to face
every court works slightly diffently so just check through everyones account of their day in court for info as everyones is slightly different.
