I really think you ought to sort that income out because by right it is not yours and I am guessing they will want you to pay back the over payment. Once that is done then all you will have is benefits to live on.
An IVA is not suitable for you, so don't even consider it.
I think you need to sort out the wage that is not meant to be paid to first, see what comes of that, then look at going bankrupt.Namaste DeeDee x0 -

dont add HB CTB just put what you pay rent and tax wise ie if you are on full beneifts then CT will be nil. so basicly just put your benefits you recive in your bank.

i have contacted my ex-employer and they said they dont know how much longer it will go on. apparently as long as i still fufill the criteria on the form that their insurance company sends me annually i will qualify to receive it until such time they say different. do you all think that i should call back the first person i spoke to at clear start who was nice and tell him the couple of extras you have suggested adding on and see with his surplus of £509 that they might bring those amounts a bit and tell him i want to go bankrupt and see what he says. what exactly does the solicitor ask you when he rings you and what information do you have to supply when proving your income and your expenditure, someone mentioned 3 months of bank statements?0 -

lisa, here is a list of all the benefits i receive, if you need amounts then let me know but they are pasted further up the thread. have made one decision today and that is to ring disablility department direct and find out what is and isnt counted. will pop back when i know

i was just looking for number to ring to disability people to querie what is classed as income and saw that from 27 october a new benefit will replace incapacity which will be called employment and support allowance. after reading through some of the literature you are tested not on what you cant do any longer but on what you can do! and will give you support to enable you to take on work in whatever format you can.
i did think the system that was in place was a little strange in that you applied for incapacity after statuatory sick pay ended and if you qualified then that was it, you got your money and there were no follow up forms or calls or visits or anything. which is why i suppose some people have been on the benefit for 28 years but are fit as a fiddle (documentary on ch 4 tuesday). so now i may not even qualify for this either when time comes or will only qualify for part of what i used to get????0 -

have filled in missing amounts for you RAS have also just rung DLA for advice and they said
"no matter what my DLA should not be counted as income. even if i were to win the lottery tomorrow i would still be disabled and would still receive benefit, it is to be used in addition to your income to help with every day needs that arise due to your disability"
this amount makes all the difference in their figures as to whether they recommended an IVA or bankruptcy. but i seem to remember them saying that they did count it as income no matter what??? has anyone else had any experience regarding DLA being used as income?????0
