ddavis, reading through DS3727's post I think you may have missed what he is complaining about. He seems to state that he is fully aware that a voucher can be cancelled and the company are well within their rights to do so to non-valid applicants. His gripe seems to be that his order was confirmed by Freemans and he received written confirmation, I think this may indicate a contract has now been formed but I'm not sure how legally binding that would be.
If you read the T&C of the Tesco website they explicitly state the e-vouchers can only be used by the people who received them. there doesn't seem to be any such T&C's on the Freemans site. In fact all of their T&C are a little vauge.
As far as I was aware with the 25% freemans voucher they cancelled it because it had actually expired on the 5th Jan and was no longer valid. The problem was that their website hadn't been updated so it still accepted the voucher and it took them sometime before they realised. This is where the area becomes grey because it was their mistake they took your order and also gave you written confirmation, whether this then turns into a legally binding contract is for the experts but I would think you have a fair complaint considering they took your order, confrimed it in writing and then failed to inform you when they cancelled it.0 -
ddavis wrote:Just because a website takes an order does not mean you have a contract - Dell are a shining example of this at its best. They often make horrendous mistakes without honouring them.
Hmmmmm, not sure I agree with you on that one.Dell are renowned for honouring a large amount of their c0ck-ups although, they like Freemans, can be hit and miss whos orders they honour!
Remember the error last August - £407 for a Dimension 5150 that priced up at £827 on their website. Some orders were cancelled but most were honoured. Then only a couple of weeks ago they ballsed up with the pricing of a Dual core CPU upgrade (In effect,a no cost upgrade to add a £500+ cpu) and again those orders were honoured too when people complained to Dell....
I can see both sides of this discussion and I too, would do everything in my power to try and get the discount honoured. At the end of the day,the code has been published on quite a few internet forums and people have already received the TV's AND got the 25% discount. If there was a blanket cancellation of ALL orders for these TV's,then fair play, give up cos you won't be getting one but this is not the case here....
Good luck

When they confirmed the order, did the confirmation show the 25% discount?0

Let's get some facts straight here ddavis. Most people in the last 100 posts or so are referring to the 20% discount off first orders offer which was on Freeman's homepage. No catalogue. No email. On the homepage.
Therefore legit for ANYONE who accessed it via their homepage. Hence the reason for this discussion.
I think a potential saving of £180 on the TV in question is worth the effort of a bit of discussion and don't agree with your dismissive 'get over it' post. What's the point of a forum if not to pass on tips and experiences in situations like this. If some people end up getting the discount then it was worth it. If not, then nothing ventured etc etc.BE NICE - IT'S FREE!0 -
Thanks for the supprt guys as they say nothing ventured nothing gained.
MickKnipfler, a confirmation e-mail was received immediatley after ordering but this has 'subject to status' written on it so I do not take that as binding. It shows the discounted price because my basket was immediatley reduced by 25% when the code was entered on the website, it does mention 25% specifically though.
However, I also received a letter in the post confirming my order at the discounted price which was not subject to status. I have also received e-mails from customer services showing my discounted price and giving me an approx delivery date. So one can only presume the order had been accepted unconditionally at some point before they decided to cancel it.0 -

while I can't speak for ddavies, I think they were referring to those who had ordered using an invalid 25% code, not those (including ddavis) who had used the 20% first order discount. So, I agree with your main point about those who ordered via the homepage quite legimately hope they will get a bargain telly and want to discuss it.
However, the thread has been hijacked by those who used an invalid code (and it has mainly been these who have had their orders cancelled, apart from the very first) to continiously moan about something they didn't get from cheating the system, now find the avenue of getting 20% off is closed, and now want to take Freemans to court!
As to whether the '20% homepagers' get their goods, we shall see and it is certainly worth debating for the time being, but of course until money is taken the contract is not formed, so we are relying on Freeman's goodwill/ineptitude. Good luck everyone!0 -

If we're getting things straight perhaps you should read the entire forum? Then you will stop having a go at me whilst AGREEING with me.
I ordered with the 20% discount. I even made a point (on page 2 or 3) of saying i reccomend others do the same INSTEAD of being greedy and using an illegitimate code.
As stratford said, the thread has been hijacked by the usual bunch of people who try to go one further and order with a dodgy discount code. The order got cancelled - its life. Nothin ventured etc. I do however disagree with the 'take them to court' mentality. Because after all, ds3727 is in the wrong NOT freemans.
And thanks stratford, yes i was referring to the 25% users.0 -
I have a feeling that the 20% code is genuine and that Freemans may well honour it. The basis of catalogue companies like Freemans is that they offer interest free weekly payments to people BUT their prices are usually substantially higher than the high street. Therefore when they offer things like 20% off they are just bringing the normal inflated price down to around average price.
However, with this Samsung TV that everyone is after, it is a good model at a fairly competitive price BEFORE the 20% is applied.
For example, this same TV is currently available at Kays catalogue for £749 (26") and £1099 (32"). This is a normal 'catalogue' style price and if they offered 20% off, it would bring the price down to a normalish price.

Edited.... Obviously the long link shortcut is not allowed so go to https://www.kays.com and search for the TV if you want confirmation of their prices. The long link is:

Could not agree more. Which is why I and others didn't take the risk of using a dodgy code. It is also why (although disappointed) I won't be crying off to trading standards if I don't get the telly at a price FAR cheaper than anywhere else, especially when no money has changed hands.
For those of you interested, avforums has a poll which looks at people's current order status under a variety scenarios:

If mine gets cancelled i will get john lewis to match the other prices available, around the 830 mark and get the 5 year warranty. Then its really just 100 extra for a 5 year warranty, not bad i suppose0
