    It is a monetary claim - you're asking for performance of the contract and in the alternate for compensation if you have to buy it for more elsewhere.

    A non-monetary claim would be for e.g. specific performance - I'll let you research that and other non-monetary claims. You really should do the research before commenting.


    Any litigant may be positioned by the defence as a "chancer", or even a vexatious litigant - if you get costs awarded against you
    The "defence" - there is no such a thing in a civil case - would be better informed on what constitutes a "vexatious litigant" than you are. Pursuing a normal civil action in the first instance doesn't qualify as vexatious.

    If you bothered to look into it you'd see that there are limits on cost orders in the small claims court and they are low.


    FINALLY, the reason for my post was to suggest that if someone believes they have a case against Freemans they should pursue it themselves rather than expect another (Martin) to shoulder the burden for them. FWIW I have not ordered any item from Freemans.

    just thought i would say i got my 26" cancelled and got my £24 cashback actually paid through a certain site, so they didnt win completely.

    Now I just have to explain to the wife why we need to spend £480 to replace our 26-inch monster 10-year-old bedrooom telly with a tarty new 26-inch IDTV LCD... Hummmm. :confused:

    Just as a follow-up, my new telly was delivery yesterday. I had no problems with Freemans customer services. The whole order process went along as expected (although delayed due to low stock), and I personally have no problems in any way with Freemans. That opinion may change if I start to receive a large number of spam mails thru the door though!

    For those that care - my wife does not like it, and is unhappy that I paid just under five hundred quid for a very nice, tarty new 26-inch IDTV LCD... :confused: Was even more unhappy when I said it could not be returned (it is excluded from the returns policy unless defective).

    If the return policy was not in place at the time of ordering (and it wasn't for most of us) then you can argue that factor and get it sent back.

    Trading standards would be very interested in this as this is a breach that they could do something about.

    I am unsure if their policy was clearly stated at time of ordering. I never took screen-grabs or anything like that. I just wanted a new LCD telly for my bedroom, and this deal happened to be floating about when I was looking. I was not too bothered if I actually got one or not. Without *ANY* correspondance for one whole month I thought that I had "missed the boat" (I suppose this is one negative I can report!). Then my wife took a call from them - and you know the rest.

    Most of the people on this thread have probably tried to buy one of these telly's so they can sell them (thru eBay and the likes)... and now moan because they have their order cancelled. I have been on these forums for long enough to know that anything that looks "too good to be true" is usually just that - and to whinge about it just makes you look silly / petty. I am a legitimate first-time buyer from Freemans --- and I certainly have no intention of reporting them to Trading Standards. It is probably down to ~75% of the people posting on this thread why I did not get my telly last month instead of this month!

    Everyone to their own... and I know some people make a living from buying low on the internet and re-selling high via eBay... and good luck to them.

    Urm, you've totally ignored my point.

    You mentioned that your wife wanted it returned but you are unable to due to their recent change in policy.

    Which is wrong, my point is you could certainly argue the fact it was not there when you ordered (from what you said you ordered long time before me and it was no in place then)

    So if you really didn't want it you could argue that fact and try and get it sent back with the threat of trading standards (who would be interested in this as this is a clear breach of sales act)

    Personaly I don't care what your reasons to purchase it was for, or anyone elses for that matter, you made a comment and I was trying to help assist you with advice to try and get it sent back (as you indicated that is what your wife wanted)

    That's all.

    Good news.

    I have today been contacted by Trading Standards (Cornwall) who referred my complaint about Misleading Price Indications to West Yorkshire Trading Standards (parent company Gratten). The complaint is upheld, and over 100 complaints were received. Freemans have admitted a mislead and have said they will honour all the orders for the 30% discount for all the people who complained. If you did not complain, can I suggest you contact your own/W Yorks TS and do so. My TS have told me that Freemans will be telephoning me in the next 7 days to arrange delivery - watch this space!!!
