I suggest everyone gets in touch with their local Trading Standards. Mine have been brilliant. There are two parts to the complaint. Firstly, if you received an email confirmation or letter with a delivery date (even one that is open ended) and the correct price, then you have formed a contract with Freemans. Unfortunately this is a civil proceeding and as such would require you to fight it yourself through the Small Claims Courts.
The second complaint is much more in our favour. Whilst it cannot force Freemans to give you the item at the discounted price it can ensure that they correctly advertise a code. In this case even though there are T&Cs which cover codes, the fact that the homepage link (on about page 68 or 69 of this thread) clearly states 30% off everything (with no asterisk or reference to non discounted items) then there is a case for Misleading Price Indications contrary to Consumer Protection Act Pt 111 . As such this is an Act which is under Criminal Law and dealt with via Trading Standards.
If anyone feels aggrieved then they should write to their TS stating they felt misled under the CPA and enclose a copy of the screen print (thanks to the poster of this). If enough people do this then Freemans may come in for a huge fine. In the meantime email Sarah Gibbs at Freemans and advise her this is what you are doing.

Excellent post, Windym. I "bought" this TV a few weeks ago and have been sent the wrong model (money still not refunded), then was fobbed off with a number of inconsistencies and outright lies. I still have no idea whether or not I will receive it but I will give Freemans a deadline of next Monday to resolve both issues before considering taking them to the Small Claims Court and/or contacting Trading Standards, etc.0

got another letter yesterday..... (see post #1423 )
Telling me that my order for the 26" tv was still on back order and will
be delivered as soon as they come back into stock!
Just rung freemans and the lady there says the order has definetly been cancelled because my credit card company refused the funds. Sounds like
this is becoming there standard excuse as my had card has thousands of pounds of available credit....0 -

Yes but it is quite likey your card did decline the purchase doesnt matter how much credit you have avaliable. It is judged on odd shopping habits. I have just had a letter from tescos because i complained about this as they declined my transaction (if they hadnt i would have got my tv) they go on to bore me to death about protecting my card against unusual shooping habits and fraud, if i had been in a shop they would have got the store to phone for autherisation as it was mail order they couldnt so declined it. I got 1500 points out of tescos for the complaint but i am still !!!!!! off about loosing the £300 discount.
But freemans are rubbish and do come out with some rubbish excuses"Save the cheerleader - Save the world"0 -
Egg called me once when I made a rather big purchase to check whether I genuinely used the card to make payment. I don't understand why Tesco or any other card companies can't do that? It's just a call and wouldn't cost them a lot.0

I ordered the new model 32" Samsung LCD TV and had confirmation e-mail on 23.4.06. I then received a letter from Freemans as follows:-
Dear ********
Thank you for your recent order to the value of £700.00.
Due to their popularity our stocks of the goods you requested are temporarily exhausted. However further supplies are expected within the number of days shown below.
I am holding your order and will ensure that it receives priority attention as items become available.
Your credit card account will only be charged when goods are despatched.
Please accept my apologies for any inconvenience caused.

This letter was dated 27th April 2006 so as it has now passed 12 days and the TV is showing 'in stock' on the website I decided to give them a call and was told my order has been cancelled as the code is not valid on electrical items. I stated that it showed as 30% of everything and I had received the above letter but she told me the discount is 'subject to status' and that they would have cancelled it when they went to process it when the item came back in stock.
I am a bit annoyed that they did not at least contact me to advise that they have cancelled the order but I can't complain as really it was not my code to use!!
Oh well, will have to wait until the next one - maybe it will be 40% off;)

Rather than getting Trading Standards involved, is there nothing that the Money Saving Expert himself could do. He has quite a high profile these days I'm sure a very vocal word with Freemans may make them honour their pledge to gice a 20% discount on ALL first orders or even the 30% off EVERYTHING......0

I think it's rather impractical to expect Martin to intervene in all the failed contract issues that arise on these boards.
Really if you have formed a contract then take it upon yourself to pursue the matter in the Small Claims Court. The Court staff are extremely helpful to people especially if you have not used the process before. I have little doubt that freemans would honour the contract rather than incur the costs associated with fighting these cases. Remember you have to have formed a contract before you are able to sue.0 -
If Martin started to intervene on this one then other people would expect the next deal to be taken care of as well and so on. So i really don't think that's going to happen as it's like opening a can of worms.
By the time u fight and win or lose the case i expect another deal would have arrised on some other site.

Ordered a masterchef food mixer :got a letter today saying credit card company declined to debit your account.
Phoned american express and gave them an earfull as we have 20.000 credit allowance said we were going to cancel the card, they said we will check out who refused the transaction and they were sorry for any mix up.
They called back in under 5 minutes to tell me they had no request for funds from Freemans and asked me to send them the letter i received and will be getting in contact with freemans to ask them what are they are playing at.0
