Anyway, I have some good news for you - I went to the jobcentre yesterday (such a pessimistic bunch they are, they had even got a new claim form prepared for me to claim JSA:rolleyes:) so I told them that I hadn't gone to sign on but to sign off:j Now I have to work dammed hard to get some clients, more cards need to go into my local florist (I put a few in yesterday) as she told me that all my cards had gone. I have booked onto some chamber networking events too so hopefully that will bring in some clients.
I have sent off my forms to my lovely new MSE accountant too and the chamber will be helping me with the horrid WTC form so that I can get some money otherwise I shall have to stick a skirt on and go and stand outside selfridges with it hitched up showing a bit of leg:eek:

Monday's jobs:
a) Ring and arrange dates for tree surgeon, fencing people and builders to come in for final quotes - tree surgeon done and quoting for fencing too. Holding off onbuilders til make a decision about whether to sell the house
b) Ring insurance company for final response.....then download form from Ombudsman Done see previous posts. Now have their official letter today, full of apologies but no dosh. Ombudsman form will be filled in by end of week
c) Order skip...for garden clearance efforts when Numpty's here...:D:D
No need, tree surgeon taking everything away
d) Sort out jewellry to take to auctioneers free valuation day next friday

e)Take pictures and send email to auctioneers for valuation of signed Bath rugby shirt (took me 2 hours on the internet yesterday to identify the year for the team signatures.......finally decided it was 1999/2000 - has some good siggies on it including Guscott, Catt and Tindall....:D) Done
However i have also
f) confirmed work contracts until March 2010 with clients and now have a guaranteed income that will be enough to live on this financial year :T
g) Completed and Invoiced all work for April :j
h) Finally sourced and ordered suitable flood door non-stick/releasing stuff for when Numpty comes down (we have to take down, spray and then put up again - twice yearly maintenance :cool:)
i) Bought a tailors dummy to take clothes piccies for ebay
j) spent qite a lot of time on interet looking at houses for sale - nothing at all in the area/price bracket with the sama functionality as my current house
k) been to docs, got meds etc and sorted out referral for diagnostic procedure to be done _pale__pale_
l) Been asked to play keyboards in a band :eek::eek:.........and sing :eek::eek::eek:
Still got buckets of ironing to do but off to see potential client this afternoon. Back on later....

He read the letter out verbally over the phone...so no mistake I'm afraid....it's in line with the "compensation for stress and inconvenience" payments awarded by the Ombudsman. The fact I am claiming for incurred financial losses (i.e. NOT compensation) as a result of the negligence/mismanagement of the claim by their agents doesn;t seem to cut any ice and they "do not cover consequential losses" .
Alas, they have the wrong end of the stick. You are not claiming for consequential damages from the flood, you are claiming for consequential damages from their negligence.
The flood only happened for a single day, their incompetance was ongoing. If they had done their job correctly, you would not have had consequential losses.Major rethink now required...may have to sell and take the triple financial hit of credit crunch plus defective building work plus flood record/ropey bridge....rather than plough more money that I haven;t got into the house.....gutted....

Unfortunatly you will now have to wait for the ombudsman. More patience alas. It won't go to court once the ombudsman has had a go. It would take a brave judge to say "I think they did fine, and the Ombudsman doesn't know what they're talking about."

Z - You've hit the nail on the head and I'm a bit peed off with the insurance company as I have made it clear to them in all my correspondence and telephone calls that the claim is NOT for
a) compensation
b) consequential lossess arising from the flood
and I always state it is for consequential losses arising as a direct result of them and their nominated agents mishandling/inaction.....I just haven't mentioned the words "professional negligence" yet....;)
The Ombudsman has told me to detail all financial losses that have occurred as a result of the poor service I have received (i.e. that wouldn;t have occurred if they had done the job properly in the first place). Had a couple of attempts to fill in form but now letting it "brew" before a final re-write this weekend.
On a good note everyone- I've just had a telephone call confirming one of the work contracts will be for more work than originally anticipated. :j:jSo I now have two firm contracts for regular work for the next 10 months which will keep me out of mischief, means I don;t have to work a full 5 days each week and yet will cover all my monthly outgoings and some. What a relief.....:D:D. (The "as and when" sporadic work I have been touting for over the last few months will therefore now be a bonus if/when it comes in)
And on that note, I am toddling off today to Leonardslee Gardens as the rhodoendrons and azaleas are early this year, the weather is glorious (Numpty - I will take you there when you are down here....it's very pretty and full of lots of "weeds" :rotfl:).....and it's bank holiday weekend.:dance::dance:
