    She then said I dont even know whether or not you have recieved it as we get loads of con artists and that why we dont take responsibity for lost mail.

    She's either taking the p*** or she is unaware of the law; you have a contract with her, and she is accountable for making sure a package is delivered, not just posted. She is the one who has paid for the Post Office's services and so she is the one that needs to claim.
    Open the Paypal claim sooner rather than later, Paypal will ask her for her evidence, and if she's got the PO to investigate, they might well hold off on the refund until there's an outcome BUT if you don't open it within 45 days, you lose your opportunity, and a post office investigation can take longer than that.
    Make it clear that you don't think it's her fault, that you have no intention of leaving negative feedback and you appreciate everything she's doing (doesn't cost anything to be sweet), but you just want to do things 'formally' via Paypal, who won't do a refund immediately anyway (which she'll know)

    Its a ebay shop so she is being awkward I beleive.

    Just had an email from paypal. The claim has been closed and I have been refunded.
    Due to her providing them with invalid tracking infomation.

    What do you think that means? I bet she's livid now.

    It means she never sent the item or was silly enough not to get proof of posting - having tired to bully you and you not cave in, she lied to Paypal and has been found out.

    Don't forget to leave negative feedback to alert other buyers to this dodgy seller (allegedly).

    Proof of posting, even recorded would not have been enough to stop the claim. The seller needed to have prove delivery.

    It's good to see the paypal system working as it should.

    Agreed, but if she had one, I'm sure that she would have either refunded without hassle and claimed from the RM, or at least provided a copy.

    A fine example of not giving in to bullying though.

    Invalid tracking no, means they've picked a no out of the hat, or a blank recorded slip, PP are clamping down on sellers like that.

    I cant believe this has happened again on the 5th Jan I ordered a birthday present for dd guess what, its not arrived.
    Message the lady who sounded lovely and assured me she posted it on the 6th. I do believe her, and she said she was sorry and hoped it turned up.
    Ive waited and waited and still nothing. I've rang and been to the sorting office nothing.
    Its now fast approaching dd's birthday and I've shelled out money for a present I dont have. I'm obviously going to have to buy her another present.
    I mentioned to the lady about what she wants to do if say by next week the gift hasn't arrived. 'I dont know she said this hasnt happened before I believe I would have to make a claim from RM, or you may have to do it I'm not sure she said'.
    I told her she would be required to put in a claim, and refund me.
    This was Saturday since then she has not responded to any of my messages. One to repsond to the above, Another yesterday to say no mail again , and another today to say no mail again.
    I now think I'm being ignored.
    What worries me now is making a dispute out of this, when I have only made one in the last couple of weeks. Does that look dodgy.
    I have been an ebay member since 2004, and until a couple of weeks ago have never had missing mail now I've had two in the space of weeks.

    What do you think I should do next?
  • Is it something that could fit through the letterbox? If not its worth trying your local post office as my parcels get sent back there instead of the sorting office now.
