    If she still want me to wait until she has been refund from Royal Mail, what do I do?

    Got to your paypal account and start a dispute.

    I have just had another message again saying that she will only refund once Royal Mail refunds her, and the claim is processed.
    What should I say now?

    Say nothing, just open a paypal chargeback for item not received.

    Do not worry about feedback yet either, wait until it is all resolved and base your feedback on how your seller deals with it now. if you do get a refund before paypal decide the case then maybe a neutral or a positive even if she refunds in the day or two after opening the dispute. If however she makes you waait until paypal actually refund you on her behalf, then neg her.

    She cna leave you nothing but positive feedback. However, give her one more chance yet to resolve this matter amicably.

    Have you been to your local sorting office ? If not this is the one and normally only thing I woulod expect a buyer to do just in case it's there.

    Well I think everyone has covered it. My only thing would be time of year might mean I would leave it a couple of extra days.

    On the other side of the coin you bought from a powerseller who is suggesting they are doing you a favour to chase it up! That would just annoy me.

    Just start the dispute when you feel it is right to do so without being unreasonable.

    She has message back saying Im being out of order. She says they normally dont chase RM and stated in their listings. She was being kind enough to chase for me and now I want a refund. She says I cannot expect her to be out of pocket while she waits for RM.
    She then said I dont even know whether or not you have recieved it as we get loads of con artists and that why we dont take responsibity for lost mail.
    I dont think she is going to back down and give me a refund.
    Once I open a dispute how long do i have to wait before getting refunded or could paypal side with the seller?
    Am I being really mean here.?

    You are not being mean at all, it is the sellers responsibility, as a powerseller/business seller they have to adhere to regs & law, so don't feel sorry for them.

    You can escalate your claim in Paypal at anytime for them to review the case for a decision.

    Was the item supposed to be sent tracked? Ie recorded, what did it say on the listing?

    Basically PP will not side with the seller unless they have proof of delivery.

    No it wasnt sent recorded, just normal post.

    I have tried to be resonable and helpful but obviously this is not good enough for you, my feedback is testament to how we opperate in a profesional manner, we will comply with our listing and as it says will forward the proof of posting certificate to you. by purchasing from us you agrred to our terms and we will comply with them it is now your responsibility to pursue any claim against Royal mail. Under no circumstances will we make a refund until such time as RM processes the claim because you have proof we sent the item but we have no proof it wasnt received. Your proof certificate along with a copy invoice will be sent recorded delivery tomorrow.

    Now what do I do?

    Escalate your claim now (I think you need to start a dispute and then start the claim) - what would the seller do if she ordered from M&S or Tesco and it didn't arrive - bet she wouldn't expect to be the one chasing the delivery company ?
