    Do I have to replace or refund an item that gets lost or damaged in the post?
    When a business sells an item to a consumer, the default position is that any loss or damage to the item that occurs in transit is the responsibility of the business. This means that you are likely to be required to replace items lost or damaged in the post.


    Also make sure you file a Seller Non Performance report against them, as this will ensure their cards are marked.

    Whats a sellers non performance thingy and how do I do that?
  • I am not sure if I am allowed to post links to eBay here? Being as I am new here...

    But basically, if you file a report, every report against the seller means they will have the a/c limited and may even get suspended from eBay.

    If you go to the help pages of eBay and type in seller non performance, all the details come up there under the first link, and with a report option on that page.

    i buy and sell on ebay, and i posted an item 2 days before new years eve, not recorded delivery and the buy emails me yesterday to say that it was not received, but as far as i can see its not my fault, and looking through this thread , i can see why the seller doesnt want too refund the buyer.... ( this may come accross as snotty but is no way intended!!!)

    but i would not be in a position to pay out for a refund if thats what the buyer wanted, personally i thin it would be reasonable for the seller to wait and get the refund from RM before passin it on/
    only my 2 penneth worth but just thought i would add my bit:o

    You don't get much choce in the matter though. You can't start a RM claim until 15 working days have elapsed (so 3 weeks basically) and it can take another 2-3 weeks before RM pay you out. You then get only item cost plus actual Postage paid so hopefully your postage charges to the buyer were accurate otherwise you'll be out of pocket.

    By the time all that has elasped your buyer has slammed in a paypal chargeback, got a refund and left you a negative. So you either refund , through gritted teeth if necessary, but before the buyer gets irritated enough to open a dispute, or paypal take the money from you and refund anyway and you are likely to be negged.

    No buyer is going to wait the 5 weeks or more for you to get a refund from RM, they only have 45 days to open a chargeback anyway and there are very few buyers who will let that deadline pass.

  • Just stop talking to the seller & escalate your claim. Going round in circles & sending messages will not get you a refund as they've quite blatantly said that they won't. And bad spelling too. Not a great impression of the seller I must admit! Open your dispute & escalte to a claim now & make sure any further messages (if you have to communicate anymore!) are done through the dispute console. HTH :)

    What should I do when I receive the proof of postage receipt tomorrow by recorded delivery.
    Do I accept it or not.
    How can she claim it if i have the receipt?
  • Do not under any circumstances sign for anything!

    That is the oldest trick in the book to make sure the seller has a proof of delivery!

    Refuse it and it will be returned.

    As above, do not bother communicating with the seller, unless it is via the PP dispute console.

    Just to echo what has been said above, DO NOT sign for the POP slip as if the seller is pulling a fast one she can claim you signed for the item.
