i buy and sell on ebay, and i posted an item 2 days before new years eve, not recorded delivery and the buy emails me yesterday to say that it was not received, but as far as i can see its not my fault, and looking through this thread , i can see why the seller doesnt want too refund the buyer.... ( this may come accross as snotty but is no way intended!!!)
but i would not be in a position to pay out for a refund if thats what the buyer wanted, personally i thin it would be reasonable for the seller to wait and get the refund from RM before passin it on/
only my 2 penneth worth but just thought i would add my bit:o
This really is a perfect example as to why sellers should always use recorded/traceable methods of postage.
It is the seller's responsibility, same as it any company you purchase from online to ensure you receive your goods.
As long as you pass these costs on, then no one loses.0 -

Aww don't worry, it is the law, not just a keyword in eBay policies, she has not a leg to stand on & trying to throw her weight around.
If she has a balance on her a/c, PP will already have "your" money on hold, she is only annoyed at herself for not being able to bully you.
Keep all communication to the PP dispute console now, and don't be intimidated, or sign for anything!

Just to add Once I have opened a claim how long does it take before paypal refund?
She has come across really nasty and obviously like to be in control. I must of really upset her.

You can escalate at anytime, you only have 20 days to reach an agreement or the case will be closed.
In this instance, I would escalate the dispute straight away.
Paypal will ask you for information, you can include all her snotty emails!

Now I'm confused. I have escalated the dispute to claim.
When I go into my paypal account it says Requiring action
when I click on it I can't see what action they want me to take. It just explains that th seller has provided a RM Tracking number and this info
What happens next
If you still haven’t received your item, you don’t need to do anything. We will review the information submitted by the seller and contact you with any developments by 10 Jan. 2009

If in doubt phone paypal tomorrow, there appears to be a slight glitch and over worked employees. The tracking she has provided is almost certainly as we feared and is the POP being sent to you. The key is communcation.
Buyers need to allow a sensible time for it to turn up. Ask them to allow 21 days from posting, but re-assure them that you will refund if it does not arrive in that time.
Unfortunately, it does mean that the seller has the cashflow issue of waiting for the RM refund, but Paypal will always find against, so better to do it amicably.0 -

I think she very annoyed with me.
Her reply, to me, suggests she knows she is going to lose and is dragging it out as long as possible just to pi$$ you off.
As a powerseller myself I always add the tracking numbers onto paypal, which in turn emails the buyer with the details.
It has certainly deterred the wannabe scammers, and "claims" have dropped from about 1 in 50 to zeroTerms & Conditions Apply0
