Most good cameras have a macro feature, use that.

No idea what that is, I've had problems trying to upload photos from my phone before with large file sizes, i spent hours a few weeks ago trying to upload a picture to a forum and just gave up in the end. I've copied out the letter which is in response to my letter as well as the bailiffs letter on the other forum.

The first letters i received from the council are generic letters which follow the normal Newcastle City Council PCN layout and wording. I know this because i've had a ticket before and my boyfriend occasionally gets them because his street is permit only, a couple of times we;ve forgotten to put the visitors pass in my car if i've taken his car and mine is at his, plus he runs a van hire and car service centre business so often has to bring a van home when a customer needs to use his car as a courtesy car. The permit for his car can only be used on his car so he therefore needs to put the visitors permit in other vehicles. He's had all sorts of bother for a number of reasons, i think he's only had to pay one fine so far and it was because the back few inches of one of the vans over hung the markings for the permit bays, he just paid it in the end to sort it out but it was really unfair, it was the only place he could park, it was only a couple of inches and if the other cars had parked correctly instead of leaving huge gaps between each other so they can each park directly in front of their house he would have been able to fit in the space. sorry i digressed a bit there but the point is i know that the first few letters are standard word for word carbon copies.

Yes, but those standard 'carbon copies' could all be flawed and you could have got off all of them if that's the case! You would be amazed how common it is for the small-print on the back of a PCN to be flawed. You are assuming all those PCNs you've had before are worded OK, I would assume they are all not OK until proven otherwise, getting early advice from pepipoo if I got a PCN myself.

Pepipoo will struggle to help you much without pics at some point, and I am not sure how many responses you will get to a thread without documentary evidence as it doesn't give people anything to go on.

Macro on a camera is the close-up option I think (picture of a flower on some phones).

Edit: I see that Glacier2, a regular and wise pepipoo poster, has explained what you must do immediately:

    QUOTE
First! Hide the car, preferably in a lock up garage.

Obtain a TE9 witness statement. Complete and immediately fax it to TEC. This will stop the bailiffs.

Also you need to fill out a TE7 form also.

I see from your pepipoo thread that you are querying the advantage of this action. I believe:

    1. It will call the bailiffs off but you must fax it to TEC and then also check with the Council I think, that they have been made aware of it and called the bailiffs off. Very urgent, do the fax to TEC and then call the Council in the morning. Can you put the car in a private car park for the day (a Supermarket car park where the only danger is another private rubbish ticket = nothing!).

    2. The case then gets re-set to NTO stage which will give you the chance to appeal properly (with pepipoo's help you an get off the fine I hope, most cases are successful).

HTH, why would you pay when all you have to do is a fax and a phone call, and then you'll have another chance to appeal with expert help.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the reply, my main point is that i was breaking the rules at the time i got the ticket and only appealed initially as i had nothing to lose by putting a appeal in on the grounds that i had just nipped to the shop to get some change. So it's unlikely that i will get off the fine now. I thought to myself at the time that even if the appeal was unsuccessful and i had to pay the £25, at least i'd given it a shot, obviously when they started losing paperwork it because more of a matter of principal. My car won't be parked at home tomorrow as i will be out most of the day and early evening working. I don't really have any other option other than to park on my street because of the permit situation in place, the nearest car park like the one you've suggested is a few miles away, out of the city. i'm just going to risk it being outside overnight tonight, i might have a rethink for tomorrow night and then i'm away from Tuesday morning until the end of the week. Even parking it on adjoining streets outside of the permit times is still a bit risky, it's an orange Land Rover so it's easy to spot if the bailiffs do show up and have a drive around, if they clamp it on an adjoining street i'm less likely to catch them doing it and therefore try to reason with them (which i know is probably not even worth my breath).

The points you make above 1) if i pay tomorrow it also prevents bailiffs taking any action and then the matter is over and done with and i don't need ot worry about my car getting clamped or possibly incurring more charges.

2)I tihnk if the case gets reset to the NTO stage i be highly unlikely to get the fine cancelled because i was actually at fault and i admit this.

I know you're trying to help by offering your advice and i thank you for it, i'm just struggling to see how paying an extra £35 and then still risking having to pay the £93 and possibly more charges is a better option. If it goes back to the NTO stage does the fine then return the the £50 fine with the extra £43 taken off? Will i get the £35 refunded to me if i'm successful? I'm assuming so. But then if i lose would i then be out of pocket by £128 plus whatever other charges they decide to add?

It's up to you of course, but you misunderstand why and how you'd be likely to get off the fine.

Most people who post on pepipoo have committed the contravention, they are 'bang to rights' it seems. Like you, on the face of it.

But then most get off the fine completely because pepipoo know the exact legal wording that PCNs, NTOs and all the documents have to say. As Glacier2 said to you, it's highly likely the PCN wording is flawed (if not the PCN then another letter, or the lines & signs, or the procedure they did/didn't follow in ignoring your appeal!).

So, you'd get the case re-set to NTO stage and then pepipoo can look at all your letters and tell you where the Council have failed. IMHO there's bound to be something, just reading your case suggests there has been procedural impropriety on their part. I suspect there will be lots of points to appeal on, as you have had several letters, but you'd have to post up pictures of them.

Personally I would not pay £93, but it's up to you as it's your money. If you get off the fine you clearly will pay nothing at all - and pepipoo are likely to get you off the fine. What more can I say?

Start a new thread. Why is all this in a Euro Car Parks topic???
  • Have followed the advice on here since I got a euro car park penalty notice in Dec 2009 and I have received all the letters in the scam but hey-ho just my luck I have received a new one today not listed in the sequence of letters. It's from controlaccount plc again and it's now telling me that their legal department have assessed my file and considered my account viable for litigation. " and recommending proceedings be issued forthwith. In an attempt not to incur our Client with the inital expense of litigation we confirm that our offices would be prepared to accept the above settlement sum from you as an end to thie matter. This payment does however need to reach us within Fourteen days of the date of this letter." The settlememt figure has reduced from £79( which was on the last letter) to £50. I have never been in touch with them at all.
Things are pretty bleak in our household at the moment (husband's department is closing) and other things and now the icing on the cake!!!!:(
Please advise a weighed down money saving lady.:sad:

Sorry for the troubles you having at the moment, can I lighten the load a little for you in regards to these scammers though, just completely ignore them as their tickets are NOT enforceable in law, so basically just useless invoices.

Wish you the best of luck on getting back on your feet
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

You can ignore the letter completely of course. :D Load of codswallop.

It seems this is a new tactic letter by Control Account, others have reported it too.

If you have access to a camera or scanner, could you find time to post it (with ID and barcode/refs blanked out) on the sticky at the top of the board 'PPC letters/threats, what to expect'?

It would help others to see what letter to expect next. I never got this one after my ECP ticket, I think they've forgotten about me!

Offering a discount is always a sure sign of utter desperation on their part. As others have said, carry on ignoring.
  • A big thanks to all who replied. Sorry don't know how to thank your individual posts. Trust me to be the one they pick on to follow it through. Will they take it any further? without reading your replies i would have paid ages ago. I'm gullible i know!!!:o
