Euro Car Parks 'Parking Charge Notice'

• Have followed the advice on here since I got a euro car park penalty notice in Dec 2009 and I have received all the letters in the scam but hey-ho just my luck I have received a new one today not listed in the sequence of letters. It's from controlaccount plc again and it's now telling me that their legal department have assessed my file and considered my account viable for litigation. " and recommending proceedings be issued forthwith. In an attempt not to incur our Client with the inital expense of litigation we confirm that our offices would be prepared to accept the above settlement sum from you as an end to thie matter. This payment does however need to reach us within Fourteen days of the date of this letter." The settlememt figure has reduced from £79( which was on the last letter) to £50. I have never been in touch with them at all.
Things are pretty bleak in our household at the moment (husband's department is closing) and other things and now the icing on the cake!!!!:(
Please advise a weighed down money saving lady.:sad:

I also have received this letter. I have ignored the first four letters but now that I have received this one I am getting nervous as I can't afford to start paying legal costs.

Any advice and not just opinions?

ignore .... you need to check the top of this forum for standard letters - I bet it will be among there somewhere.

That is exactly the reaction they want, they are trying to scare you. You wont be paying legal costs because Euro simply don't do court, ever.
Carry on ignoring, you are very near the end. Offering a discount is always a sign of utter desperation on their part. If they thought they had a case against you they would have issued court papers a long time ago instead of sending stupid letters.

It isn't just opinions on here, it's factual advice.

In my handbag I have all my letters sent by Euro Car Parks to me over 2 years ago. I laughed when I saw their sorry attempt at faking a PCN and just filed all the letters because I knew about this generic scam. Nothing happens, these are not real fines, not real PCNs.

Euro Car Parks have never done Court, they admitted it in the national press last month (most PPCs are the same). It's simply not the way they work, they rely on threats scaring mugs into paying up. Not being funny, but don't be a mug!

Watchdog have covered this generic scam last year, with a legal expert showing you what to do with one of these bogus tickets. It's really easy to ignore Euro and Control Account and I would happily collect more of their fake PCNs just to cost them money and show the retailer that their PPC is powerless at stopping people parking for hours in their 2 hour limit car park.

We have pictures of each and every Euro letter on the forum stickies as well as the Watchdog clip, all you have to do is read Crabman's sticky threads at the top of the board. See my signature where I mention the link to click (top of page) to view the whole current forum. Read the stickies and several threads, you'll soon lose that nervousness!

Most of us here want PPCs kicked out of retail car parks - their practice (akin to a protection racket when you think about it) is hardly in keeping with good business practice and encouraging repeat trade and passing trade for retailers. Sending threats to their paying customers & families, who just happen to be the registered keeper of a car which was parked there one day - ridiculous idea in a recession! A sure way to lose business.

Happy reading of our forum threads. If you stumbled across this single thread when Googling the company you'll be amazed when you read the whole forum board and info, it's a very common subject!

Euro seem to be using a new tactic, at least in Scotland. A poster over on CAG recently received a phone call from a company called Walter Love ("Sheriffs Officers") saying unless the person paid them £95 they would "arrest his wages". All nonsense of course, as nothing like that could happen until the case goes to court.

Now that is surely illegal.

Shocking. Still ignore them though OP, just shows how desperate they are.

• Parking Charge Notice (PCN) is often a notice that a company intend to take the car owner to court for trespassing, and will offer to let you pay some money to settle the case out of court.

If you ignore the PCN the fee may increase, dependent upon company. If the PCN Company take you to court and they win, your fee shall increase even more.

To dispute the PCN should be possible although, make shore you have all the facts right. To say you parked just 10 minute would be a mistake. If the company signage is clear i.e. no parking, warning PCN in operation (don' park there).

I would say that at times we all make mistakes and park in the wrong area, my professional opinion is accept the mistake and pay the fee before the price increases.

There are many companies issuing PCN’s and all for a small cost have the ability to gain your details and contact you. Euro Car Parks, Parking Control Service, Alpha Traffic Management, Central Ticketing, APCOA, SPS Parking and so many more.

I need help please!

This has been touched on before in previous threads, but does anyone have a link to the actual law regarding my obligation to paying a 'Parking Charge Notice'. People have offered opinions but I could do with the facts to put my mind at rest.

I received a ticket on my car for parking in a no parking area. It was parked for 10 minutes in a place that is widely considered and used as a parking area, and Euro Car Parks seem to be a recent addition to the area...

I consider myself to have 2 options.

1) Dispute the invoice
2) Ignore it

Thanks in advance!

Just to correct some errors. Most PPCs won't take people to court because they will not win. The so-called "details" they will obtain is the name and address of the registered keeper. This may not be the actual driver . Unless the PPC can obtain the identity of the driver then they can't proceed any further. As regards "disputing " the case. Don't bother. The whole "appeals" procedure is flawed as it's not done independently.

The best plan is to ignore any correspondence from the PPC and not to contact them. This works 99.9% of the time. The PPC will lose interest and will then move on to some other sucker, where they will try and frighten that person to pay up with a lot of pseudo-legal mumbo jumbo.

By the way concerned citizen 2011, what PPC do you work for?
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

concerned citizen 2011,

"my professional opinion is accept the mistake and pay the fee before the price increases".

Could I ask what profession you represent? Some rather disturbing advice and incorrect information offered in your post!

Parking Charge Notice (PCN) is often a notice that a company intend to take the car owner to court for trespassing, and will offer to let you pay some money to settle the case out of court. Only the landowner can sue for trespass, not the PPC. PPCs usually threaten to sue for breach of contract, which of course they can't do because their "charge" is in fact a penalty.
If you ignore the PCN the fee may increase, dependent upon company. If the PCN Company take you to court and they win, your fee shall increase even more. Increasing the "fee" doesnt make it any more enforceable, and as we all know they never go to court anyway.
To dispute the PCN should be possible although, make shore you have all the facts right. To say you parked just 10 minute would be a mistake. If the company signage is clear i.e. no parking, warning PCN in operation (don' park there). Never dispute a PPC invoice. There is no appeals process, they just want your money.
I would say that at times we all make mistakes and park in the wrong area, my professional opinion is accept the mistake and pay the fee before the price increases. Rubbish. Ignoring works, the regular posters on here including me are living proof of that. Why should a private company profit because someone makes a mistake?

Wrong again, they can only find out the details of the registered keeper, who is not necessarily the driver.

The bit about clamping is your only sensible comment.
