I'm seriously considering a DRO, as I've just totalled up my outgoings and my income...it's not good. Currently un-employed and even the jobcentre are messing around in deciding if they are going to pay my JCA so at the moment I have no income whatso ever, and have been jobless since January.
what I want to know is, What happens when the DRO is in place and you have the money spare as your wouldnt be paying out as much money as you used to when the DRO was not in place, I'm kind of confused about this?0 -

In order to qualify for a DRO you must have less than £50 surplus BEFORE any payment to creditors.I used to be Snow White, but I drifted.Mae West

Can anyone help/advise me on this before I go mad with worry?!
I submitted and had accepted a DRO last week. It all got accepted and should be all done and dusted in upto a months time I have been advised.
But since then, I have had three separate charges sent to me from one of the banks I put on the DRO form, the charges are for over-the-overdraft limit- I submitted that bank as part of the DRO so would assume it is covered- but is it covered for the extra charges? Also, and more importantly, am I covered for the extra costs themselves?
I submitted for £250 for that bank. I could now well owe £300 plus the three £35 fees so in reality, I am in debt to that bank for around £400 and not the £250 I submitted.
What happens now- am I covered for the £400 actual debt or just £250 submitted for?
I am really worried about this as one of the payments that went over the £250 was a lekkie bill, and another was a cheque to my therapist, which says is paid in the letter with the charges, but is it?! : can they claw back the money as its over the £250 initially claimed for? am I now looking at still having debt after the DRO?
HELP!!
Thanks to anyone in advance...0 -

The DRO was accepted on the 15th of June, the letters: One is dated the 12th of June, the other is dated the 16th of June. Both arrived to me after the 15th when the order was accepted. (One arrived the 18th the other today on the 20th).
I had checked my account on the 12th and saw it was £250 overdrawn so I knew what to put on the form. I thought everything ahd gone through... If I would have known there were charges, I would have included them! Why are banks so slow to get information on the system?!
I have been informed the charges will come out of the account later on this month. (There is no money to cover them).
I am sleepless with this!! Nightmare! The biggest worry is that the order will only cover the £250 and I will be liable for the additional charges and bills... I can't afford them- after paying for the DRO I now have nothing left!0 -
i don't have an answer i'm afraid, i know my bank account with hsbc was £200 more than stated on my dro, they have said they are closing down the account, but i don't know if that £200 is included iyswim, i am now onto day 17 as hopfully noone will object in the next 13 days-someone tell me if that is wrong0

Good to know I am not alone in this! But this sleepless night thing, I thought that was supposed to be over once the DRO was filed- it seems to be more stressful then before!
I have though, read (on the copy of the t's and c's of the order sent to me in ths post)
Discharge from Qualifying Debts:
Subject as follows, at the end of the moratorium applicaton to a debt relief order the debtor (thats you and I) is discharged from all the qualifying debts specified in the order including all interest, penalties and other sums which may have become payable in relation to those debts since the application.
It doesn't really answer the question, as the penalties and sums I am worried about are not as a result of the original debt- they are additional to it. I am most worried about the cheque as it would need to be paid again pronto where as the fees and etc I can imagine paying a little at a time (for a very very long time).
I should be asleep now....(still can't sleep!) Good luck with yours though, be good to hear if it works out:o0
