Debt Relief Orders (DRO) - Information & help thread

    OK After sleepless nights over this, I have at last been able to speak to my money financial person about the fact I places the DRO for £250 on one bank but actually owe £420 (as a result of three extra payments comming out of the account, and three extra overdraft fees.)

    I have been told that I am infact liable for the costs- the charges I will be able to fight (so £105 I will be able to get taken off the extra amount now due) but the cheque and extra payments? I am still liable for those.

    I guess the moral of the story is, wait for every single cheque to go through- I thought all my payments had gone through. I swapped over my direct debits, but this one cheque which I had paid, had not been included as it did not show up on my account until the next working day after the DRO had been passed.

    Just incase anyone is in a similar boat.
    I think maybe I will wait to have the cheque clawed back by the bank before I issue it out again, but in the mean time, fingers and toes crossed they give me a bit of time- I have no money left to pay off the cheque now- I can't afford to buy food until tomorrow! (Ryvita all the way!!)
  • hi jenniewb, and thanks for that info, i completly agree about waiting for every last debt to get paid out of the account but i am woried now about where to find £200 from, but that is a bridge i will have to cross [STRIKE][/STRIKE]if [STRIKE][/STRIKE]when they come asking for it

    Hi

    I stumbled across some info on DRO's while doing some work at CAB (I am training to be a volunteer) and I think I qualify for one.

    At the moment my OH and I are in a joint DMP with CCCS. We don't actually have any joint debt though, most of it is mine, approx. £13k is in my name. Most of that is from a previous relationship.

    I am in receipt of IB, DLA and HB. My total incoming (incl DLA) is £793 and my total outgoing is £896 (half of all the monthly outgoings and incl my DLA) as you can see, I am in the red by £103.

    I'm not sure if they would let me apply for a DRO because my partner is working and earning £15k? I didn't know if it worked the same as benefits, both incomes are included?

    Any advice would be greatly appreciated. :) xx

  • hi hayley 11, as far as i know only your partners contribution to household expenses is included in your soa for a dro, they will not look at his whole monthly income, don't worry about it and get the ball moving, you are near to the dro limit, and charges etc can soon increase it

    hi hayley 11, as far as i know only your partners contribution to household expenses is included in your soa for a dro, they will not look at his whole monthly income, don't worry about it and get the ball moving, you are near to the dro limit, and charges etc can soon increase it

    You and me both! I have though been told that any charges (fees from the bank) are disregarded, so that reduces things for me a bit. Though its all fun and games trying to get the fees disputed and everything, at least they will eventually be repaid. You didn't say but if that does apply to you, its worth knowing exactly what your £200 is made up of.

    I was though, told that they may not recall the extra amount owed- that as its all quite new, no one knows for sure, it may just be ignored- but at the banks discrepancy or however they deal with it, but that as the guide says, they are only covered for the amount on the form, no extra then what is stated. Be good to find out if it is/isn't requested for- maybe some banks will send a bill and some banks wont. Fingers crossed they do disregard any debt, but I have been forewarned otherwise.

    RE: paying it back though, I am sure that you could work with the CAB or whomever were seeing you for the DRO to work out some sort of payment- prior to my DRO I was paying GE Capital whom I owed £270, £2 a month and that had been agreed. It would have taken me 11 and a half years to pay back:eek: But at least it was manageable!

    I've contacted CCCS and I do qualify for one. I have filled in all the info and am now just waiting for the paperwork from them and then I can contact their intermediary team. :)

  • hi, i received a soa from jd williams-one of the creditors named in my dro, do i have to fill this in? and why do they want to know about my money or lack of it?

    Always ignore things like that, they're trying to catch you out by getting you to admit to the debt/debt issues. Leave it well alone, they can't hold you responsible if you don't sign anything!
