Debt Relief Orders (DRO) - Information & help thread

    Hi everybody, my DRO was accepted last week but today a letter dropped through my door from one of my creditors saying they had now taken back their debt from a DCA, they have given this debt a different account no.
    So how do I stand as this account is now back with a bank but is listed on my DRO as with a DCA with totally different account no, will it be discharged or will it not show in 12months. any help/advice appreciated

    Hi,

    You dont need to worry about that, the debt is still part of your DRO. If you have any problems contact the insolvency service.

    I know that some have received a good service form B&E but.............

    they are in it to persuade you in to a DMP instead. I have a client who went to B&E for a DRO, fitted the criteria but was told she had too much spare income, which simply wasnt true. She enrolled on DMP instead(after also being told that she could never work as a bar manager if she goes for a DRO) which cost her an enrolment fee of £125 and a monthly management charge.

    I am making a complaint, I want her money back, and im probably going to report them to the insolvency service.

    Hence why I would only advise B&E as a queue jump, for people who are nearing the 15k limit and are worried that time might run out.

    Just thought I would get back to everyone:

    I had claimed my DRO on the 15th and one of the banks it covered I said I owed £250. Little did I knw, a cheque and two further amounts were to appear. These three also had added charges as I went over my overdraft.

    I had asked if it was still covered by the DRO and indeed it is not.

    The bank have chased me for the cheque and debits that went through. I also have the fees to come off the account- though I am in financial hardship and have an Ombudsman award previous charges in my favor- so will be contacting the ombudsman again about these- and hoeping they get resolved faster then previously.

    Hope others learn my lesson- make sure you check your statements properly, and also remember cheques which can be claimed up to 6 months after you have written them!

    I know that if you say the balalnce is below the actual figure then you end up paying the difference but what if you claim it's higher than it turns out to be?

    There apears to be no penalty for overstating your debt (unless it takes you over 15k obviously)!

    And the lesson we learn is...

    I am seriously considering a DRO but need someone to talk to one to one who can explain everything and answer any questions I have and calm my worries maybe even go through my debts with me to see if it really is my only other option and tell me if it realy is my best option.

    I am struggling as it is at the moment to pay prority household bills and trying to pay £1 token payments to all 10 creditors as I do not qualify for a DMP with CCCS as my outgoings on priority debts are not a lot less than my income, im on longterm benefits and theres little hope for a better financial future at the moment anyway :(

    Is there anyone out there who is already on a DRO that can give me more experienced info?

    The official word to us from the insolvency service is that best guess estimates are acceptable when the true balance is not available. It does not matter if you have over estimated any particular debt, so if in doubt - over estimate !

  • I'm in the same boat Crisp. We're not able to go into a DMP as we're both out of work and unlikely to be able to get back on our feet until our baby is born and I get another job. Its either this or bankruptcy and I don't think we'll be able to afford that step.

    I'm going to the CAB soon to speak to someone.

    That's a good decision - the CAB are doing about 80% of DROs at the moment.

    I note applications (not submissions) passed 5000 today!
