  • hi all. my partner has had a DRO over 12 months ago, but they haven't been in touch. Are his debts written off now?

    Well i would have thought so yes unless he had a furter order placed that increases the length of the DRO but you would know about that.. Give the Insolvency people a call and just give them your case number and they should be able to update you.

    If by further order you mean a restriction (undertaking or order), it does not effect the end of moratorium......all debts are still cleared at the end of 12 months provided the rules of DRO are adhered to.

    Isn't there some thing that they can place on you that extends the length of the DRO..?.

    No, only the restrictions in a DRRU similar to a BRU in bankruptcy as far as I'm aware and can think right now, but I haven't got the guidance to hand to double check. In reality though you're much more likely to have your DRO revoked than get a DRRU.

    Hi again

    Does the DRO income and expenditure allow for things like haircuts, social outgoings, even a small amount of tobacco?

    I actually found the application form online and their I&E seems very basic.

    Also, is there a minimum amount you have to owe to apply for a DRO

    2nd question. The fee is £90 so would say the CCCS only request this if they were sure the DRO would go through ok? Because I think she would have to not pay her creditors for a few weeks to get this £90 together.

    The £90 is for the application, although we have a good idea if it'll be accepted or not, we can't guaratee it as it's down to the OR and the £90 is nonrefundable if it's declined or revoked at any time within the 12 months.

    As for expenditure the DRO application is based on the BBA trigger figures which you will need to discuss with your money advisor. The things you mention would go either under your housekeeping (tobacco) or 'other' expenditure, and so long as you don't exceed the trigger figures it should be fine. In some circumstances you can exceed them if you have a reasonable explanation. However money advisors aren't allowed to tell clients what those figures are... hence me seemingly being very vague! lol

    Nope, but the maximum is £15000.
