Yes, DROs are personal and so in your cases would be based on sole income/debts etc, or anything which is joint. Your household bills are more complex so I would recommend speaking to a debt advisor about the best way for you both to do a DRO and your financial statements, as there are many ways you could do it.

What do you do with the bills immoral..? If they are joint do you split it if you both were going for a DRO, or if only one is doing it, does it then fall on the one NOT doing a dro to carry on paying it...?

If they were my clients I'd look at what names the bills are in, as well as what income each of them has and work something out around this, or if we had full household bills on each financial statement I'd include a 'partner's contribution' in the income. I would use the whole bill amount though in most cases. Sometimes it is easier to split the bills but it depends on the circumstances.
That or you could just do a full whole of household FS for both of them if the expenditure was below £50 anyway. Would need to see their income/expenditure to see which was the best way of doing it, there's so many variations sometimes you need to try a few things to get the most accurate FS!

  • ok, everything is in my partners name though as the tenancy is...but i have to pay my share.

Also when they are working out your £50 disposable income is this after you have paid all your creditor minimum payments? If we didnt have to pay all our creditors we would probably have more than £50 (not a lot probably a few pounds) but after we are in serious defecit!

last question lol do mobile phone contracts and landline/internet count as household bills?

The disposable income is before repayments on any debt you're going to include in the DRO. Household bills is all 'reasonable domestic expenditure' and will include anything you pay money to, within set guidelines which your advisor will speak to you about.

What benefits are you on? Generally state benefits are seen to provide you with the basic minimum of living... are you able to post an SOA on here as it's difficult to say for certain without seeing it?

Not sure if this has been posted elsewhere but the DRO website is being upgraded this week.

Applications can be worked on but NOT submitted (which is a bit of a pain as I've got a client who needs a DRO fast to have something to wave at the council's bailiffs!)

Back to normal on 18 Oct!
