    I dont know the exact date but I think its been there about 10 yrs now. Maybe another 4 or so before that behind the bales.


    Is there a cut off point where they will give up trying to knock it down?

    It would be a bit of a circular argument to delay the knocking down with appeals then say, well its been there too long now

    you hope to quietly sell it to a friend who lives in the castle too. You hope the local council won't notice.
    After four years the friend says ya boo sucks I'm home and dry.
    Might not work in such a high profile case.
  • The only downfall in that argument is that once an Enforcement Notice has been served, the 'clock stops' in terms of the period being claimed for immunity from enforcement action - so as the Council served an Enforcement Notice pretty promptly, any further time since then does not count towards the four year period of immunity... if that makes sense!

    Would it work fort a property with an agricultural occupancy condition?
    Assuming the council failed to notice that the cowman had moved out to be replaced by a wealthy newcomer pensioner from the city?
  • For non-compliance with a planning condition, the period is 10 years (before it becomes immune from enforcement action). If no enforcement notice had been served in that 10 year period, and the Council had failed to notice wealthy Mr Bloggs from the city living there continuously during that period... then yes, it would be immune from enforcement action (although as always, the onus is on the applicant to show that this was the case!).

    Whilst it does happen, I wouldn't say it's 'very very often' - just 'often' maybe! lol

    In my experience, parish councils are pretty hot on reporting this kind of breach, as they tend to know which dwellings are subject to agricultural occupancy conditions.

    Wouldn't say my neighbours are wealthy city types, though!

    As for the parish council.....err....they know what's going on, but then look who's on the parish council! ;)
